Section 410.12, Subd 7, thereby amending the Charter by ordinance.
If the Council agreed, a public hearing would be held (two weeks notice
required). After the hearing, the Council could adopt the amendment, but it
would require a unanimous vote by Council. If the vote is unanimous, the
ordinance becomes effective 90 days after passage and publication.
4. If we choose this route we have to pass two resolutions:
a. Resolution to approve the charter amendment as submitted to us;
b. Resolution recommending that the Council approve the amendment
pursuant to Section 410.12, Subd 7.
5. The same process of amendment by ordinance could be utilized if we
propose a revision to the amendment. In that case, the Council would have to
agree with our proposed revision first, and agree to the recommendation to pass
the amendment by ordinance.
Whether we submit our approval as is or submit a revision, the City Council
has two options, depending on the outcome of their vote:
a. If the Council vote on the resolution to approve the amendment is less than
unanimous it will then require use of the referendum process (go to ballot)
b. If the vote is unanimous on both the wording of the amendment and the
recommendation to approve it pursuant to Section 410.12, Sub7, the issue
would not be submitted to the voters, but would follow procedure in number 3
above.
The subcommittee's recommendations will be presented and discussed at the
meeting In order to meet our timeframe, please do everything possible to attend
this session. We will make this item the first order of our "Old Business."
Respectfully submitted,
Paulette Warren
-19-
