COUNCIL MINUTES April 24, 2017 <br />DRAFT <br />3 <br /> 91 <br />Mayor Reinert noted the recent growth of the city’s American Legion. They are a community based 92 <br />organization and they are thriving and need additional parking. He is supportive of the project. 93 <br /> 94 <br />Council Member Kusterman noted the city’s regulations regarding entry/exit (driveways) into the 95 <br />property. Staff reviewed the only access point for the Legion that ultimately will serve their parking 96 <br />lot as well as development that occurs further south on the site. 97 <br /> 98 <br />Council Member Manthey remarked that he is glad that the Legion has come forward to this point in 99 <br />their project; they are an organization that does a lot of good in the city. Also the overflow currently 100 <br />has tended to move to the fire station lot. 101 <br /> 102 <br />Council Member Manthey moved to approve Resolution No. 17-33 as presented. Council Member 103 <br />Kusterman seconded the motion. Motion carried on a voice vote. 104 <br /> 105 <br />6B) North Pointe 5th Addition: i) Public Hearing, Consider 1st Reading of Ordinance No. 04-106 <br />17, Vacating Drainage & Utility Easement, Outlot A, NorthPointe 3rd Addition and Outlot C, 107 <br />NorthPointe 4th Addition; 108 <br />ii) Consider Resolution No. 17-34, Approving PUD Final Plan/Final Plat – 109 <br />iii) Consider Resolution No. 17-35, Approving Development Agreement; 110 <br />iv) Consider Resolution No. 17-36, Approving Public Improvement Surety Agreement 111 <br /> 112 <br />City Planner reviewed a presentation including: 113 <br />- Site (by aerial), including size (39 lots); 114 <br />- Compliance with city plans; 115 <br />- Phasing (8 phases planned); 116 <br />- Inclusion of outlots for future development; 117 <br />- Requirement for a public hearing for the vacation of utility and drainage easements (they will 118 <br />be rededicated); 119 <br />- Public land dedication fees; 120 <br />- Park Board’s work on plan for NorthPointe Park; 121 <br />- Planning and Zoning Board review and ultimate approval; 122 <br />- Requested council action. 123 <br /> 124 <br />City Planner Larsen noted a correction to the legal description included in the development agreement 125 <br />and surety agreement. Staff will also add bank information to the surety agreement. 126 <br /> 127 <br />Mayor Reinert recalled that the land of this development was slated for medium density and could 128 <br />have been townhomes but he’s happy with the single family homes that are being developed because 129 <br />they are a better match for this community. He explained that an element of senior housing planned 130 <br />for one phase increases the density and that allows for the single family product. Also he’s happy 131 <br />that the park will be included for the residents at the front end of the project. 132 <br /> 133 <br />Mayor Reinert opened the public hearing. 134 <br /> 135
