<br />SITE IMPROVEMENT PERFORMANCE AGREEMENT

<br />
<br /> THIS AGREEMENT made this _______ day of _______________, 2017, is by
<br />and between the City of Lino Lakes, a municipal corporation organized under the laws of
<br />the State of Minnesota, and Forest Lake School District #831 (Developer).
<br />
<br /> WHEREAS, the Developer has received approval of Site Development Plans,
<br />hereinafter called the "Plans", by the City of Lino Lakes on the 14th day of November,
<br />2016, and in accordance with the Plans all of which are made a part hereof by reference.
<br />In consideration of such approval, the Developer, its successors and assigns, does
<br />covenant and agree to perform the work as set forth in the Plans, in the aforesaid
<br />approval, and as hereinafter set forth upon the real estate (hereinafter referred to as
<br />"Property") described as follows:
<br />
<br />05-31-22-44-0001 (Parcel 2) & 05-31-22-44-0002 (Parcel 1)
<br />
<br />Parcel 1:
<br />That certain part of the Southeast Quarter of the Southeast Quarter (SE 1/4 of SE 1/4),
<br />Section 5, Township 31, Range 22, Anoka County, Minnesota, described as follows, to-
<br />wit: Commencing at a point on the South line of said Southeast Quarter of Southeast
<br />Quarter, 650 feet West of the Southeast corner thereof; thence West along said South
<br />line, for 660 feet to the Southwest corner of said Southeast Quarter of Southeast Quarter;
<br />thence North 1 degree 18 minutes East, along the West line of said Southeast Quarter of
<br />Southeast Quarter, for 660 feet; thence East, parallel to described first course, for 660
<br />feet; thence South, parallel to described second course, for 660 feet to the point of
<br />beginning.

<br />That part of the Southeast Quarter of the Southeast Quarter (SE1/4 of SE1/4) of Section
<br />5, Township 31 North, Range 22 West, Anoka County, Minnesota, described as follows:
<br />Commencing at the Southeast corner of the Southeast Quarter of the Southeast Quarter of
<br />Section 5; thence West, along the South line of the SE1/4 of the SE1/4, a distance of 650
<br />feet; thence Northerly, parallel with the West line of the Southeast Quarter of the
<br />Southeast Quarter, a distance of 660 feet to the point of beginning; thence West, parallel
<br />with the South line of the Southeast Quarter of the Southeast Quarter, a distance of 660
<br />feet, to the West line of the Southeast Quarter of the Southeast Quarter; thence Northerly,
<br />along said West line, a distance of 659.96 feet to the Northwest corner of the Southeast
<br />Quarter of the Southeast Quarter of Section 5; thence Easterly, along the North line of the
<br />Southeast Quarter of the Southeast Quarter, a distance of 660.29 feet to the point of
<br />intersection with a line drawn through the point of beginning and parallel with the West
<br />line of the Southeast Quarter of the Southeast Quarter; thence Southerly, along said line,
<br />a distance of 658.75 feet to the point of beginning.
