• <br /> COUNCIL MINUTES July 11, 2011 <br /> APPROVED <br /> 91 6B) First Reading of Ordinance No. 15-11, amending the zoning ordinance regarding variances <br /> 92 —City Planner Smyser explained that the 2011 State Legislature amended state law relative to criteria <br /> 93 for granting of variances. The criteria amendments involve the findings of hardship and conditions <br /> 94 that may be attached to a variance. The ordinance before the council would update the city's zoning <br /> 95 ordinance to reflect the changes in state law. The Planning and Zoning Board conducted a hearing on <br /> 96 the proposed amendment and recommended approval. <br /> 97 <br /> 98 Council Member O'Donnell moved to approve the first reading of Ordinance No. 15-11 as presented. <br /> 99 Council Member Roeser seconded the motion. Motion carried on a voice vote. <br /> 100 <br /> 101 UNFINISHED BUSINESS <br /> 102 <br /> 103 There was no Unfinished Business. <br /> 104 <br /> 105 NEW BUSINESS <br /> 106 <br /> 107 8A) Emergency Ordinance No. 16-11, adding a new Chapter 1012 to the Lino Lakes City Code <br /> 108 establishing an electrical inspection program and Resolution No. 11-74 authorizing execution of <br /> 109 an agreement with David Kichler Inspections to provide inspection services—Community <br /> 110 Development Director Grochala explained that with the current state shut down, cities are looking at <br /> 111 picking up electrical inspection duties that were performed by the state. He is therefore proposing <br /> 112 that the council approve an emergency ordinance (under the charter allowance that the situation is a <br /> 113 health safety matter) adding an electrical inspection program. The language would sunset when the <br /> 114 state shut down ends. In the future, the council may want to consider making it a permanent situation <br /> 115 but that is a discussion for the future. Since the city doesn't have staff to accomplish the electrical <br /> 116 inspection, the action requested includes authorizing a contract with a private inspect <br /> 117 <br /> 118 Council Member O'Donnell moved to waive full reading of the ordinance. Council Member Roeser <br /> 119 seconded the motion. Motion carried on a voice vote. <br /> 120 <br /> 121 Council Member Roeser moved to approve Emergency Ordinance No. 16-11 and Resolution No. 11- <br /> 122 74, as presented. Council Member Rafferty seconded the motion.
