He noted even if the Board recommend <br />denial, the Council did not have to concur. <br />Mr. Johnson noted that it would appear that to deny or not deny at this time would not <br />be consistant with previous action of this Board. The Board has always requested input <br />from the City consultants before coming to a decision. <br />Mr. Reinert moved to table any further action on the preliminary plat documents as sub- <br />mitted as stated in El Rehbein & Son's letter dated January 8, 1979. Mr. Johnson seconded <br />the motion. Motion declared passed. <br />Mr. Reinert moved to request the opinion of the City Planner and Engineer in regard to <br />the requeded rezoning and preliminary plat of Outlots H, J & K of Lakes Addition #2 and <br />this information be provided to each Planning and Zonimg member prior to the February <br />meeting. Mr. Heath seconded the motion. Motion declared passed. <br />Plat - Oak Knoll - Brian Dobie <br />Mr. Dobie had arrived and the Board considered the Oak Knoll plat. Mr. Gourley asked <br />if all documents were received and the Clerk said yes. Mr. McLean asked about the street <br />Blue Bill Lane and Mr. Dobie said the City.Attorney had the abstracts for the street and <br />Mr. Dobie said documents were prepared to grant Mr. Van Kl.eek ownership of the land to <br />the street easement. <br />Mr. Reinert moved to recommend approval of the plat subject to approval of the legal do- <br />cuments required for conveyance of the street right of way and to also include the letter <br />of credit for street construction. Mr. Heath seconded the motion. Motion declared passed. <br />Rezone - Gene Mobley <br />Mr. Mobley has requested that the property he owns on 22nd Avenue be rezoned from Limited <br />Business to General Business to allow for full use of the land. <br />Mr. Heath moved to recommend to Council approval of the request subject to payment of the <br />fee. Mr. Johnson seconded the motion. Motion declared passed. <br />Feasibility - Swenson <br />Mr. and Mrs. Swenson presented a drawing of lot 12 in Equity Estates and asked if it <br />would be possibie.to.sp.Jit this 10 acre lot into three lots and install a private drive <br />and obtain building permits on all three lots. <br />Mr. McLean explained there is presently a moratorium on splitting lots by metes and boumds <br />in this City. Mr. Gourley explained that the Board has consistantly requested that lots <br />meet City Code, 150' on an established street and felt even if the moratorium were lifted <br />the Board would recommend denial of any request to divide any lot without the required <br />street frontage. Mr. McLean suggested that Mr. Swenson have an engineer plot a street <br />giving each lot the required frontage but with minimum length of street. <br />Special Use Permit - Richard Klenck <br />Mr. Klench requested a Special Use Permit to house vehicle over 9,000 lbs on his property <br />on Rolling Hills Drive. Mr. Klenck has completed the form and has the signatures of the <br />surrounding property owners. <br />Mr. Reinert moved to recommend approval to the Council subject to payment of the r,<red <br />
