k Aft, <br />Page -3- <br />July 21, 1978 <br />Mr. McLean asked the residents if they were just concerned with Shenandoah or the entire City. <br />Mr. Berg said just Shenandoah and possibly Shenandoah II. <br />Mr. McLean explained that only the landowner can put convenants on land and restrict the build- <br />ing. The City could not legally compel) the builder to build garages. <br />Mr. Berg said they had talked to North Northeast Realty but didnit find any answers. Mr. Mc- <br />Lean suggested talking to Mr. Glenn Rehbein since he is the actual landowner. <br />Mr. Berg asked when the street off of Birch Street on Totem Trail will be repaired and black - <br />topped. Mr. McLean said this question had been asked at the Council recently and Mr. Gotwald <br />is suppose to contact Mr. Rehbein about this. <br />Sign Ordinance <br />A letter from the Minnesota Department of Transportation had been recieved apologizing for <br />the six year delay in certifying our Sign Ordinance. <br />There are several areas of the Ordinance that need to corrected before the Ordinance can be <br />certified. The first area is Section 3, A - 4. The City Attorney had looked over the letter <br />and our Ordinance and recommended some changes in the Ordinance so that it could conform to <br />State regulations and be certified. <br />The letter indicates that there can be no signs allowed in an agricultural district by Special <br />Use Permit or by any other manner and the City Attorney recommended deleting this section. <br />However, the Board felt this was too restrictive and suggested leaving part A - 4 in and add- <br />ing. "except roads adjacent to interstate and trunk highway systems". <br />In Section 4- A -I "Advertising Signs", the City Attorney recommended adding "and divises" to <br />this heading. The Planning and Zoning Board agreed with this change. <br />In Section 4 - A - 2, the City Attorney recommended deleting all but "shall be allowed in <br />industrial park districts as a special use, if they meet the following conditions;". However, <br />the Board suggested leaving this in but adding after special use, "except roads adjacent to <br />interstate and trunk highway systems." <br />The City Attorney suggested adding 9 to Section 4 - A. It reads "Shall not be erected or <br />maintained: <br />(1) In or within 500 feet of national parks,state parks, local parks, historic sites, and <br />public picnic and rest area; <br />(2) Within 100 feet of a church or school. <br />The Clerk was asked to check these changes with the City Attorney and have the Ordinance re- <br />typed and returned to the July Planning and Zoning Board for action. <br />Mr. McLean reminded the Board members of the special Council meeting with the Hugo City <br />Council regarding Otter Lake Open Space and invited anyone who wished to attend. <br />Mrs. Schwankl moved to adjourn. Mr. Shearen seconded the motion. Aye. <br />
