Application of Rice Lake Elementary PTO 47 to conduct two excluded bingo events Approved 48 49 FINANCE DEPARTMENT REPORT,AL ROLEK 50 51 There was no report from the Finance Department. 52 53 ADMINISTRATION DEPARTMENT REPORT, DAN TESCH 54 55 3A) First reading of Ordinance No.03-10 amending Chapter 701 of the City Code relating to 56 Liquor Licensing—City Clerk Bartell explained that the ordinance proposes two changes to the city 57 code as it relates to liquor licensing. It was determined recently that there is currently a requirement for 58 a conditional use permit for outdoor serving(liquor)areas however the city's zoning regulations do not 59 provide for a conditional use in certain zoning districts. The city attorney recommends therefore that 60 the language be removed. The second change relates to an amendment forwarded to the council by the 61 Planning and Zoning Board. The board recently considered some zoning amendments regarding 62 outdoor dining areas and sent forward a recommendation to add language to the liquor code that 63 clarifies a licensee's responsibility for order and containment in outdoor areas. 64 65 Council Member Gallup moved to approve first reading of Ordinance No. 03-10, as presented. 66 Council Member O'Donnell seconded the motion. Motion carried on a unanimous voice vote. 67 68 PUBLIC SAFETY DEPARTMENT REPORT,DAVE PECCHIA 69 70 There was no report from the Public Safety Department. 71 72 PUBLIC SERVICES DEPARTMENT REPORT,RICK DEGARDNER 73 74 There was no report from the Public Services Department. 75 76 COMMUNITY DEVELOPMENT DEPARTMENT REPORT,MICHAEL GROCHALA 77 78 6A) Resolution No. 10-16,Approving a Conditional Use Permit to allow fill in the floodplain at 79 the Chomonix Golf Course- City Engineer Studenski explained that golf course owner Anoka 80 County is planning to replace two bridges this winter and, as part of the project,will be mitigating 81 some floodplain and wetland areas. The course has wetland bank credits they can utilize to allow this 82 mitigation. Mr. Studenski reviewed the hauling plans for the materials that will be brought in and out 83 of the park. The city code requires a conditional use permit for the fill placement involved in this 84 project. The project should be completed by March 31, 2010. Mr. Studenski recommended a change 85 to the resolution to add the following language to condition 4, "or as agreed upon by the Public 86 Services/Safety." 87 Council Member O'Donnell moved to approve Resolution No. 10-16 with the change recommended by L 88 staff. Council Member Roeser seconded the motion. Motion adopted on a unanimous voice vote. 89 2
