It was determined recently that there is currently a requirement for <br /> 58 a conditional use permit for outdoor serving(liquor)areas however the city's zoning regulations do not <br /> 59 provide for a conditional use in certain zoning districts. The city attorney recommends therefore that <br /> 60 the language be removed. The second change relates to an amendment forwarded to the council by the <br /> 61 Planning and Zoning Board. The board recently considered some zoning amendments regarding <br /> 62 outdoor dining areas and sent forward a recommendation to add language to the liquor code that <br /> 63 clarifies a licensee's responsibility for order and containment in outdoor areas. <br /> 64 <br /> 65 Council Member Gallup moved to approve first reading of Ordinance No. 03-10, as presented. <br /> 66 Council Member O'Donnell seconded the motion. Motion carried on a unanimous voice vote. <br /> 67 <br /> 68 PUBLIC SAFETY DEPARTMENT REPORT,DAVE PECCHIA <br /> 69 <br /> 70 There was no report from the Public Safety Department. <br /> 71 <br /> 72 PUBLIC SERVICES DEPARTMENT REPORT,RICK DEGARDNER <br /> 73 <br /> 74 There was no report from the Public Services Department. <br /> 75 <br /> 76 COMMUNITY DEVELOPMENT DEPARTMENT REPORT,MICHAEL GROCHALA <br /> 77 <br /> 78 6A) Resolution No. 10-16,Approving a Conditional Use Permit to allow fill in the floodplain at <br /> 79 the Chomonix Golf Course- City Engineer Studenski explained that golf course owner Anoka <br /> 80 County is planning to replace two bridges this winter and, as part of the project,will be mitigating <br /> 81 some floodplain and wetland areas. The course has wetland bank credits they can utilize to allow this <br /> 82 mitigation. Mr. Studenski reviewed the hauling plans for the materials that will be brought in and out <br /> 83 of the park. The city code requires a conditional use permit for the fill placement involved in this <br /> 84 project. The project should be completed by March 31, 2010. Mr. Studenski recommended a change <br /> 85 to the resolution to add the following language to condition 4, "or as agreed upon by the Public <br /> 86 Services/Safety." <br /> 87 Council Member O'Donnell moved to approve Resolution No. 10-16 with the change recommended by <br /> L 88 staff.
