COUNCIL MINUTES August 23,2010 APPROVED 46 47 48 49 FINANCE DEPARTMENT REPORT, AL ROLEK 50 51 There was no report from the Finance Department. 52 53 ADMINISTRATION DEPARTMENT REPORT, DAN TESCH 54 55 There was no report from the Administration Department. 56 57 PUBLIC SAFETY DEPARTMENT REPORT, DAVE PECCHIA 58 59 Item 4A, Consider Resolution No. 10-74 approving the Lino Lakes Police Department 60 participation in the Safe and Sober Program-Chief Strege explained that the Police Department 61 is requesting permission to continue its participation in the Safe and Sober Program. If authorized, 62 the department would receive state grant funds administered by the City of Coon Rapids, to be used 63 for personnel and administrative costs associated with safe and sober efforts. The multi-department 64 effort increases the resources available to the city. 65 66 Council Member Roeser moved to approve Resolution No. 10-74 as presented. Council Member 67 O'Donnell seconded the motion. Motion carried on a unanimous voice vote. 68 `- 69 PUBLIC SERVICES DEPARTMENT REPORT, RICK DEGARDNER 70 71 There was no report from the Public Services Department. 72 73 COMMUNITY DEVELOPMENT DEPARTMENT REPORT, MICHAEL GROCHALA 74 75 Item 6A, Consider Resolution No. 10-65, denying a Variance to allow the expansion of a non- 76 conforming structure and reduction of a front setback for a proposed entry addition to the 77 building at 909 Maple Street - Planner Smyser explained that the subject property is currently an 78 auto repair garage where the owner has requested permission to add an auto sales lot as well as to be 79 allowed to keep a door overhang that does not conform to code and that was built without a building 80 peimit. The request for auto sales has been denied by the council and the overhang question was 81 further discussed at the last council work session. To allow the overhang on the existing non- 82 conforming structure would require the issuance of a variance and the council has heard that the 83 courts have put in place stricter criteria that apply to variance requests. Mr. Smyser reviewed the 84 criteria and staffs determinations that generally do not support a variance. 85 86 It was confirmed that the applicant has been informed as to staffs recommendation and the reasoning. 87 88 Council Member O'Donnell moved to approve Resolution No. 10-65 as presented. Council Member 89 Gallup seconded the motion. Motion adopted upon a unanimous voice vote. 90 2
