COUNCIL MINUTES August 23,2010 <br /> APPROVED <br /> 46 <br /> 47 <br /> 48 <br /> 49 FINANCE DEPARTMENT REPORT, AL ROLEK <br /> 50 <br /> 51 There was no report from the Finance Department. <br /> 52 <br /> 53 ADMINISTRATION DEPARTMENT REPORT, DAN TESCH <br /> 54 <br /> 55 There was no report from the Administration Department. <br /> 56 <br /> 57 PUBLIC SAFETY DEPARTMENT REPORT, DAVE PECCHIA <br /> 58 <br /> 59 Item 4A, Consider Resolution No. 10-74 approving the Lino Lakes Police Department <br /> 60 participation in the Safe and Sober Program-Chief Strege explained that the Police Department <br /> 61 is requesting permission to continue its participation in the Safe and Sober Program. If authorized, <br /> 62 the department would receive state grant funds administered by the City of Coon Rapids, to be used <br /> 63 for personnel and administrative costs associated with safe and sober efforts. The multi-department <br /> 64 effort increases the resources available to the city. <br /> 65 <br /> 66 Council Member Roeser moved to approve Resolution No. 10-74 as presented. Council Member <br /> 67 O'Donnell seconded the motion. Motion carried on a unanimous voice vote. <br /> 68 <br /> `- 69 PUBLIC SERVICES DEPARTMENT REPORT, RICK DEGARDNER <br /> 70 <br /> 71 There was no report from the Public Services Department. <br /> 72 <br /> 73 COMMUNITY DEVELOPMENT DEPARTMENT REPORT, MICHAEL GROCHALA <br /> 74 <br /> 75 Item 6A, Consider Resolution No. 10-65, denying a Variance to allow the expansion of a non- <br /> 76 conforming structure and reduction of a front setback for a proposed entry addition to the <br /> 77 building at 909 Maple Street - Planner Smyser explained that the subject property is currently an <br /> 78 auto repair garage where the owner has requested permission to add an auto sales lot as well as to be <br /> 79 allowed to keep a door overhang that does not conform to code and that was built without a building <br /> 80 peimit. The request for auto sales has been denied by the council and the overhang question was <br /> 81 further discussed at the last council work session. To allow the overhang on the existing non- <br /> 82 conforming structure would require the issuance of a variance and the council has heard that the <br /> 83 courts have put in place stricter criteria that apply to variance requests. Mr. Smyser reviewed the <br /> 84 criteria and staffs determinations that generally do not support a variance. <br /> 85 <br /> 86 It was confirmed that the applicant has been informed as to staffs recommendation and the reasoning. <br /> 87 <br /> 88 Council Member O'Donnell moved to approve Resolution No. 10-65 as presented. Council Member <br /> 89 Gallup seconded the motion. Motion adopted upon a unanimous voice vote. <br /> 90 <br /> 2 <br />
