COUNCIL MINUTES December 13,2010 <br /> APPROVED <br /> 131 <br /> L.22 6A. Consider Resolution No. 10-106, Determining That Off-Road Vehicle Riding Facility Is Not <br /> 133 Allowed in R-1 Zone—City Planner Smyser noted that this council has discussed this item at previous <br /> 134 meetings. Briefly,the question posed to the council is to make a determination on a use not directly <br /> 135 noted in the city's zoning ordinance. The use in question is an off-road riding facility within an R-1 <br /> 136 zone. The resolution before the council makes the determination that it is not an appropriate use. <br /> 137 <br /> 138 Char Foster, Birch Street, owner of a property on which an off-road riding facility exists, requested that <br /> 139 the council postpone the matter until spring, or when they would be able to hear for themselves the <br /> 140 riding activity. <br /> 141 <br /> 142 The council declined to postpone the matter; the question isn't about one facility but about this use in all <br /> 143 R-1 districts. The council has heard from a great number of people that the use has a negative impact. <br /> 144 The council hoped to reach a different solution but the impact on others is found to be too great. <br /> 145 <br /> 146 Ms. Foster asked if her grandson would be able to continue to use the track. <br /> 147 <br /> 148 City Planner Smyser responded that the language in the resolution before the council is written <br /> 149 specifically. It doesn't disallow occasional riding on a property but disallows riding on a track no <br /> 150 matter the age of the rider. <br /> 151 <br /> 152 Council Member O'Donnell moved to approve Resolution No. 10-106 as presented. The motion was <br /> '53 seconded by unanimous consent.
