COUNCIL MINUTES May 26, 2009 <br /> APPROVED <br /> 46 FINANCE DEPARTMENT REPORT, AL ROLEK <br /> 47 <br /> 48 There was no report from the Finance Department. <br /> 49 <br /> 50 ADMINISTRATION DEPARTMENT REPORT, DAN TESCH <br /> 51 <br /> 52 3A) Consideration of Resolution No. 09-32, providing for a finding of violation of the <br /> 53 City Code and imposing penalties against Jason's Bobby & Steve's Auto World <br /> 54 <br /> 55 City Clerk Bartell reported that previous to this evening's meeting, the council held a liquor <br /> 56 compliance hearing to review the Police Department's report and recommendation relative to <br /> 57 beer code compliance violation. Jason's Bobby & Steve's Auto World at 7090 21St Av was <br /> 58 found to have violated the city's regulations and a penalty of$1,500 and a ten-day suspension <br /> 59 (stayed for one year without another violation)was recommended by both the Police Department <br /> 60 and the City Council. Based on that recommendation, staff is presenting Resolution No. 09-32 <br /> 61 imposing said penalty. <br /> 62 <br /> 63 Jason Snyder, owner (in partnership) of Jason's Bobby & Steve's Auto World. Mr. Snyder told <br /> 64 the council that that he understands that they are reluctant to waiver from the Best Practices Grid <br /> 65 however he believes that is a mistake. Every situation is different and the seriousness of the <br /> 66 situation is very much recognized by him. He is taking steps at the business to avoid having this <br /> 67 happen again. He requests special consideration on the fine; that the fine be stayed, or a <br /> 68 reduction of the amount or extra time to pay it. There is not a lot of money in the sale of 3.2 beer <br /> �.69 at his establishment. The council discussed but took no action on the time frame under which the <br /> 70 fine must be paid. <br /> 71 <br /> 72 The council discussed the importance of being consistent in handling these violations. It is <br /> 73 important to stick with the Best Practices Grid. <br /> 74 <br /> 75 Council Member O'Donnell moved to approve Resolution No. 09-32 as presented. Council <br /> 76 Member Gallup seconded the motion. Motion carried. <br /> 77 <br /> 78 3B) Contract with Personnel Decisions Inc. for City Administrator search. <br /> 79 <br /> 80 Administrator Tesch reported that the council is considering a contract providing for the services <br /> 81 of Mr. Harry Brull to assist in the city's search and hiring of a new city administrator. <br /> 82 <br /> 83 Council Member Gallup moved to approve the contract with Personnel Decisions Inc. as <br /> 84 presented. Council Member O'Donnell seconded the motion.
