Local 260 <br /> 67 (police sergeants) current labor agreement <br /> 68 <br /> 69 Acting Administrator Tesch noted that the council had discussed these agreements at their work <br /> 70 session held just previous to the council meeting. The council has some concern about the <br /> 71 language in the agreements limiting the city's ability to lay off employees in 2010; the clause <br /> 72 would limit the council's flexibility in dealing with the budget. The city attorney was asked to <br /> 73 opine on the impact of the council not agreeing to that language in the tentative agreements <br /> 74 before them. <br /> 75 <br /> 76 Attorney Langel remarked that if the memorandums of understanding before the council <br /> 77 constitute the unions' offer and the city removes something from them,they would then become <br /> 78 new offers on the city's part. The council can certainly vote the agreements up or down; a <br /> 79 change to the agreement would put it back on the bargaining table as a counter offer. When <br /> 80 asked if the city could change elements of a labor contract mid-term, Mr. Langel suggested that <br /> 81 such a change should be requested only under the most necessary of circumstances. <br /> 82 <br /> 83 A council member noted that the council did not agree to the language in question and suggested <br /> 84 that taking it out would bring the parties closer to agreement. <br /> 85 <br /> 86 The mayor remarked that the council has a proposed agreement and should vote it up or down. <br /> 87 <br /> 88 A council member suggested that there is risk in losing the furlough concession if the agreement <br /> 89 goes back to the table; that would leave a hole in the budget. <br /> 90 <br /> 2 <br />
