AGENDA ITEM: 12B <br />STAFF ORIGINATOR: John Miller, City Planner <br />DATE: October 17, 1989 <br />TOPIC: Request for a Minor Subdivision by Brad and Helen <br />Elledge, Application #89-48. Variance #89-49. <br />Background: The applicants own a trapezoidal parcel of land <br />located in the southeast quadrant of the intersection of Lake <br />Drive and Oak Lane. There are however two legal descriptions <br />for the parcel. <br />As the attached certificate of survey shows dwelling, garage, <br />kennel and other accessory buildings are located on the west <br />side of the parcel. The entire parcel, which covers an area <br />of approximately two acres, has been offered for sale and a <br />buyer has been found for the western part of the property. <br />However, as the correspondence from Jeff Joyer shows the <br />applicants are requesting to transfer a 25 foot wide strip of <br />land from the eastern legally described parcel to the western <br />parcel. <br />According to Joyer, "The purpose of this request is to <br />eliminate a septic encroachment along the east line and <br />provide a more suitable back yard for the existing home on <br />Tract 1." It would also move the kennel and one accessory <br />building onto the western parcel. <br />In terms of area the eastern or vacant legally described <br />parcel would be reduced in area from 1.18 acres to 1.06 acre. <br />By my calculations (I'm not sure the certificate of survey is <br />accurately prepared), the western legally described parcel <br />would have its area increased from .79 acre to .89 acre. <br />A variance is necessary for the creation of an undersized <br />parcel. The Planning and Zoning Board reviewed the requests <br />on October llth. The members recommended approval with <br />contingencies as shown below. <br />Options: 1. Approve a Minor Subdivision for Helen and Brad <br />Elledge for property located at 7790 Lake Drive, Application <br />#89-48 contingent upon the 1) applicants preparing a revised <br />certificate of survey showing two 20 foot easements for <br />utilities and drainage dividing the 64Qi parcel into three <br />76.6 foot lots and 2) the newly created 25 foot parcel be <br />combined with the western parcel. <br />
