<br />5 <br /> <br />WHEREAS, in addition to the criteria established under Section 1007.016, Conditional <br />Use Permits above, Section 1007.130(8)(a) establishes the following conditions that shall <br />be met: <br /> <br />1. Side yards shall be double that required for the district, but no greater than thirty (30) <br />feet. <br /> <br />The standard side yard setback is 10 feet so a 20 foot setback is required. The proposed <br />school addition is 500+ feet from the east property line and 700+ feet from the west <br />property line. <br /> <br />2. Adequate screening from abutting residential uses and landscaping is provided in <br />compliance with §1007.043 (17) of this Ordinance. <br /> <br />Adequate screening from abutting residential uses and landscaping is provided. The <br />proposed school addition is more than 400 feet from the nearest residential property. No <br />addition landscaping or screening is required. <br /> <br />3. Adequate off-street parking and access is provided on the site or on lots directly <br />abutting or directly across a public street or alley to the principal use in compliance <br />with §1007.044 of this Ordinance and that such parking is adequately screened and <br />landscaped from surrounding and abutting residential uses in compliance with <br />§1007.043 (17) this Ordinance. <br /> <br />Adequate off-street parking and access is provided on the site. The 200 existing parking <br />stalls located off-street exceed the required 143 parking stalls and will adequately serve <br />the existing school and addition. The site is accessed via 2 driveways onto CSAH <br />34/Birch Street and these will not be altered. <br /> <br />4. Adequate off-street loading and service entrances are provided and regulated where <br />applicable by §1007.045 of this Ordinance. <br /> <br />There is no off-street loading associated with the proposed school addition. <br /> <br />5. The provisions of §1007.016 of this Ordinance are considered and determined to be <br />satisfied. <br /> <br />The provisions of Section 1007.016 are satisfied as noted above and in the March 9, 2016 <br />Planning & Zoning Staff Report. <br /> <br />NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Lino <br />Lakes hereby approves the conditional use permit amendment and site plan review for the <br />Rice Lake Elementary School Addition subject to the following conditions: <br /> <br />1. A Site Improvement Performance Agreement shall be executed and securities and <br />escrows in place prior to issuance of a building permit.
