On the Need for an Environmental Assessment Worksheet Findings of Fact <br />Bituminous Roadways, Inc. Hot Mix Asphalt Plant Project Conclusions of Law <br />Columbus, Minnesota And Order <br /> <br /> <br /> 2 <br />and toilet waste. Bituminous will install a private well for building use and for periodic spraying for <br />fugitive emissions at the Project site. <br /> <br />5. Bituminous will pave the area in and around the asphalt equipment with asphalt and will also pave <br />two access roads with asphalt. The Project site areas not paved with bituminous will be covered <br />with gravel. Bituminous will create almost 21 acres of impervious surface from the 46-acre Project <br />site. <br /> <br />6. Bituminous will construct nonpermeable secondary containment areas for the above ground <br />storage tanks that are part of the hot mix asphalt plant. <br /> <br />7. According to plan information Bituminous provided to the City of Columbus, Bituminous will grade <br />both Lot 1 and Lot 2 and install stormwater controls. Bituminous plans to install a permanent <br />stormwater sedimentation pond on the east side of Lot 1, and a permanent stormwater <br />sedimentation pond on the southeast area of Lot 2, which is adjacent to the northwest area of <br />Lot 1. <br /> <br />8. Bituminous proposes to operate the hot mix asphalt plant during construction season, which is <br />typically from April through November of each year. Bituminous expects to operate the Project <br />from 7 a.m. to 7 p.m. Monday through Saturday, but may also have periodic overnight operation of <br />the Project. Bituminous is subject to the City of Columbus’ ordinances and any additional <br />restrictions the City of Columbus may impose related to Bituminous’ days and hours of operation. <br /> <br />9. Bituminous will also hire a contractor to bring a portable crusher onto the Project site twice per <br />year during construction season, each time for a period of approximately three to four weeks, to <br />crush rubble concrete and asphalt for use in the hot mix asphalt production. The contractor will <br />then remove the portable crusher after each time period, so the portable crusher will not remain on <br />the Project site. <br /> <br />Petition for Environmental Assessment Worksheet <br /> <br />10. On July 25, 2017, the Environmental Quality Board (EQB) received a petition under Minn. R. <br />4410.1100 (Petition), requesting that an Environmental Assessment Worksheet (EAW) be prepared <br />on Bituminous’ proposed Project. The Petition designated Anthony G. Edwards, Parker Daniels <br />Kibort, as the Petitioners’ Representative. The Petition, with Appendices A through E, are <br />incorporated by reference into these Findings, as Attachment 1. Pursuant to Minn. R. 4410.1100 subp. 5, the EQB determined the Petition complied with the <br />requirements for a valid petition and that the MPCA was the appropriate Responsible Government <br />Unit (RGU) to decide whether an EAW should be prepared. See Attachment 2. <br /> <br />12. On July 31, 2017, the MPCA received the Petition from the EQB. See Attachment 2. <br />
