1 <br /> <br />CITY COUNCIL <br />AGENDA ITEM 6C <br /> <br /> <br />STAFF ORIGINATOR: Katie Larsen, City Planner <br /> <br />MEETING DATE: August 28, 2017 <br /> <br />TOPIC: Consider Resolution No. 17-85 Approving an Amendment to <br />Resolution No. 15-119 for 6602 Pheasant Run <br /> <br />VOTE REQUIRED: 3/5 <br /> <br /> <br />INTRODUCTION <br /> <br />Staff is requesting City Council’s consideration to approve an amendment to Resolution No. <br />15-119 in regards to a variance for an attached garage and detached accessory structure at 6602 <br />Pheasant Run. <br /> <br />BACKGROUND <br /> <br />On October 14, 2015, the Planning & Zoning Board recommended approval of a 10 foot <br />variance to allow the property owner, Dylan Lindman, to construct an attached garage 30 feet <br />from the lot line along CSAH 34/Birch Street. The required setback is 40 feet. <br /> <br />On October 26, 2015, the City Council passed Resolution No. 15-119 approving a 12 foot <br />variance to allow for the construction of an attached garage 28 feet from the lot line. The <br />property owner requested the additional 2 feet. <br /> <br />Per Resolution No. 15-119: <br /> <br />NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino Lakes <br />hereby approves of a 12 foot variance to reduce the required setback from 40 feet to 28 feet <br />along Birch Street to allow for the construction of an attached double garage at 6602 Pheasant <br />Run, subject to the following conditions: <br /> <br />1. The detached shed in the northeast corner of the lot, found in violation of city <br />ordinances, shall be relocated onto the applicant’s property. <br />2. The accessory structure shall meet the requirements of §1007.043 General Building and <br />Use Provisions. <br />3. The accessory structure shall meet all other city code and state building code <br />requirements. <br />4. A building permit shall be submitted for by the applicant and approved by the City of <br />Lino Lakes prior to construction. <br /> <br />The property owner thought the variance applied to both the attached double garage and <br />detached shed. He relocated the detached shed onto the property 26.8 feet from the south lot
