5 <br /> <br />Wetlands <br /> <br />A Wetland Delineation Report was completed by Jacobson Environmental, PLLC on May 23, <br />2017. Since no future development is to occur on the potential future Outlot A, delineation is <br />only required on Lot 1 near the single family house. A WCA Notice of Decision was received on <br />August 10, 2017. <br /> <br />The requirements of the Wetland Conservation Act regulations as administered by Rice Creek <br />Watershed District (RCWD) requiring a conservation easement and wetland buffer over the <br />wetlands are not applicable since the parcel is not being subdivided. Any future subdivision of <br />the parcel will be subject to WCA, RCWD and City requirements. <br /> <br />Floodplain <br /> <br />The 2015 DFIRM indicates Zone A floodplain on both Lot 1 and Outlot A. The plan sheets have <br />been revised to indicate a RCWD floodplain base flood elevation (BFE) of 886.87. Grading and <br />house construction do not appear to impact the floodplain. <br /> <br />Shoreland Management Overlay <br /> <br />The site is located in a Shoreland Management Overlay district of Wards Lake. This lake is a <br />classified as a Natural Environment Lake and has an 883.7 OHWL elevation. A setback of 150 <br />feet from the OHWL is required for all primary and accessory structures. Section 1102.07(2)(a) <br />does however, allow for the following exception: <br /> <br />“Placement of structures on lots. When more than one setback applies to a site, structures and <br />facilities must be located to meet all setbacks. Where structures exist on the adjoining lots on <br />both sides of a proposed building site, structure setbacks may be altered without a variance to <br />conform to the adjoining setbacks from the ordinary high water level, provided the proposed <br />building site is not located in a shore impact zone.” <br /> <br />The plans show the 883.7 OHWL and staff understands this elevation has now been field <br />surveyed. The OHWL setback of 6697 Ruffed Grouse Road is 56.3’ and the OHWL setback of <br />6690 Ruffed Grouse Road is 92.1’. The average setback is 74.2’. The 75’ shore impact zone is <br />the more restrictive and shall be the applicable setback. <br /> <br />The Grading Plan indicates 2.31% impervious surface coverage which meets the allowed 30% <br />impervious surface coverage of the shoreland ordinance. <br /> <br />Development Agreement <br /> <br />A Development Agreement has been drafted by the City and shall be executed by the City and <br />the developer and recorded by the developer. <br /> <br /> <br />
