COUNCIL MINUTES March 12, 2018 <br />91 Council Member Stoesz asked if -there could be any economies by bundling the work with other cities <br />92 and Ms. Hankee said that staff has investigated that type of joint effort but hasn't seen the benefit to <br />93 the City. <br />94 <br />95 Council Member Rafferty moved to approve Resolution No. l &24 as presented. Council Member <br />96 Maher seconded the motion. Motion carried on a voice vote. <br />97 <br />98 613) Consider Resolution No. 1&26 Objecting Amendments to Water Appropriations Permit <br />99 1985-6168 — City Engineer Hankee reviewed the written staff report outlining staff s work to draft an <br />100 objection to the amendment proposed to the city's water appropriations permit. Other communities <br />101 impacted are considering the same type of action to reserve future rights. She reviewed the elements <br />102 that would be considered for objection. <br />103 <br />104 Council Member Maher asked if other cities have appealed the actions and Ms. Hankee said yes, <br />105 noting White Bear Township. <br />106 <br />107 Community Development Director Grochala explained that staff recommends this action to keep the <br />108 city's options open. The city will be looking carefully at the order for any impacts or concerns and <br />109 then decide if objections are appropriate. <br />110 <br />111 Mayor Reinert explained the background that brings the city to this point. A lawsuit was brought by a <br />112 few property owners on White Bear Lake and there is a resulting legal determination. The City has a <br />113 small area included in the impacted area, shouldn't be included in the ramifications. <br />114 <br />115 Council Member Manthey commented that he supports this action because the information received <br />116 about the lawsuit indicated that communities received limited information and involvement and he <br />117 hopes this action will guarantee that the city will be heard. <br />118 <br />119 Council Member Manthey moved to approve Resolution No. 18-26 as presented. Council Member <br />120 Stoesz seconded the motion.
