COUNCIL MINUTES <br />October 8, 2018 <br />APPROVED <br />125 Council Member Manthey moved to approve the 1' Reading of Ordinance No. 1548 as presented. <br />126 Council Member Stoesz seconded the motion. Motion carried on a voice vote. <br />127 6D) Consider Resolution No. 18-133, Approving Programmatic Stormwater Management <br />128 Facility Maintenance Agreement with Rice Creek Watershed District City Engineer Hankee <br />129 reported on the City's responsibilities under law for certain Stormwater activities. As part of the <br />130 work, the City enters into an agreement with the local watershed authority laying out plans. She <br />131 noted that the proposed agreement would cover all newly permitted facilities and eliminate the need <br />132 for project by project agreements. <br />133 Mayor Reinert asked what obligation the City is accepting with this agreement. <br />134 Ms. Hankee noted first that there are many agreements already in place for projects already approved. <br />135 This programmatic agreement will cover the same types of obligations that those individual <br />136 agreements contain. <br />137 Mayor Reinert asked if the City is agreeing to anything new with this agreement. Ms. Hankee said <br />138 staff has thoroughly reviewed the agreement and found nothing different from what the City has been <br />139 accepting. It is a consolidation but it does indicate that the City will have individual agreements in <br />140 the future, if it so chooses. <br />141 <br />142 Council Member Stoesz asked if there is an end date for the agreement and Ms. Hankee said she <br />143 doesn't know of an ending period but she will investigate and report back. Administrator Karlson <br />144 noted that the agreement indicates that it is in force for five years with automatic renewal for <br />145 additional five year periods unless termination occurs. <br />146 <br />147 Council Member Maher moved to approve Resolution No. 18-133 as presented. Council Member <br />148 Manthey seconded the motion.
