COUNCIL MINUTES October 8, 2018 <br />DRAFT <br />4 <br />Council Member Manthey moved to approve the 1st Reading of Ordinance No. 15-18 as presented. 125 <br />Council Member Stoesz seconded the motion. Motion carried on a voice vote. 126 <br />6D) Consider Resolution No. 18-133, Approving Programmatic Stormwater Management 127 <br />Facility Maintenance Agreement with Rice Creek Watershed District City Engineer Hankee 128 <br />reported on the City’s responsibilities under law for certain stormwater activities. As part of the 129 <br />work, the City enters into an agreement with the local watershed authority laying out plans. She noted 130 <br />that the proposed agreement would cover all newly permitted facilities and eliminate the need for 131 <br />project by project agreements. 132 <br />Mayor Reinert asked what obligation the City is accepting with this agreement. 133 <br />Ms. Hankee noted first that there are many agreements already in place for projects already approved. 134 <br />This programmatic agreement will cover the same types of obligations that those individual 135 <br />agreements contain. 136 <br />Mayor Reinert asked if the City is agreeing to anything new with this agreement . Ms. Hankee said 137 <br />staff has thoroughly reviewed the agreement and found nothing different from what the City has been 138 <br />accepting. It is a consolidation but it does indicate that the City will have individual agreements in the 139 <br />future, if it so chooses. 140 <br /> 141 <br />Council Member Stoesz asked if there is an end date for the agreement and Ms. Hankee said she 142 <br />doesn’t know of an ending period but she will investigate and report back. Administrator Karlson 143 <br />noted that the agreement indicates that it is in force for five years with automatic renewal for 144 <br />additional five year periods unless termination occurs. 145 <br /> 146 <br />Council Member Maher moved to approve Resolution No. 18-133 as presented. Council Member 147 <br />Manthey seconded the motion.
