1 <br /> <br />CITY COUNCIL <br />AGENDA ITEM 6H <br /> <br /> <br />STAFF ORIGINATOR: Diane Hankee PE, City Engineer <br /> <br />MEETING DATE: October 22, 2018 <br />TOPIC: Drainage and Utility Easement Vacation <br />i) Consider 2nd Reading of Ordinance No. 15-18, Vacating <br />Drainage and Utility Easement 6499 Lakota Trail <br /> *Council may vote to dispense with the full reading of the ordinance <br /> *Roll call vote is required for adoption of the ordinance <br /> <br />ii) Consider Resolution No. 18-137, Approving Summary <br />Publication of Ordinance No. 15-18 <br /> <br /> <br />VOTE REQUIRED: 4/5 <br /> <br /> <br />INTRODUCTION <br /> <br />Staff is requesting City Council consider the 2nd Reading of Ordinance No. 15-18, vacating a <br />portion of the drainage and utility easements originally dedicated on Lot 1, Block 16, Millers <br />Crossroads, Anoka County, Minnesota describe as follows: <br /> <br />“All that part of the drainage and utility easements as dedicated on Lot 1, Block 16, Millers <br />Crossroads, Anoka, County, Minnesota, which lie east of the westerly 20.00 feet of said Lot 1.” <br /> <br />BACKGROUND <br /> <br />6499 Lakota Trail is the future site for Love to Grow On childcare center. The applicant is <br />requesting that a portion the existing drainage and utility easement be vacated. This easement <br />was originally designed for utility and pond access. With the proposed project layout the <br />easements are being vacated and new easements dedicated to encompass the current proposed <br />trails, ponds and wetlands. <br /> <br />The Drainage and Utility Easement Vacation Description Sketch prepared by The Gregory <br />Group, Inc. received August 28, 2018 detailing the proposed drainage and utility area to be <br />vacated is enclosed. <br /> <br />RECOMMENDATION <br /> <br />Staff is recommending approval of the 2nd Reading of Ordinance No. 15-18 Vacating Drainage <br />& Utility Easement, 6499 Lakota Trail and approval of Resolution No. 18-137, Approving <br />Summary of Publication of Ordinance 15-18.
