1 <br /> <br />1st Reading: 11/12/2018 Publication: <br />2nd Reading: 11/26/2018 Effective: <br /> <br /> <br />CITY OF LINO LAKES <br />ORDINANCE NO. 16-18 <br /> <br />ORDINANCE VACATING RIGHT OF WAY AND DRAINAGE AND UTLITY <br />EASEMENTS <br />(Sandpiper Drive) <br /> <br /> <br /> <br />The City Council of Lino Lakes ordains: <br /> <br />Section 1: Findings of Fact <br /> <br />1. The City Council of Lino Lakes has determined to vacate a portion of the street <br />right of way and drainage and utility easements dedicated with LAKES <br />ADDITION NO. 1, as shown in Exhibit A1 and A2 ; and <br /> <br />2. A public hearing was held on November 13, 2018 before the City Council in the <br />City Hall Council Chambers after due published and posted notice had been given <br />and reasonable attempts were made to give personal notice to all affected property <br />owners, and all persons interested were given an opportunity to be heard; and <br /> <br />3. It appears to be in the best interest of the City to vacate such road right of way; <br />and <br /> <br />4. The right of way and drainage and utility easements vacation shall be recorded <br />through Anoka County Recorder’s Office; and <br /> <br />5. Four-fifths of all members of the City Council concur with this ordinance. <br /> <br />Section 2: Easement Vacated <br /> <br />The right of way described herein is hereby vacated: <br /> <br />“That part of Sandpiper Drive as dedicated in LAKES ADDITION NO. 1, Anoka <br />County, Minnesota, lying westerly and southwesterly of the following described line: <br />Beginning at the southwest corner of Lot 3, Block 3, said LAKES ADDITION NO. 1; <br />thence southwesterly to the northwest corner of Lot 1, Block 1, LAKES ADDITION NO. <br />4, Anoka County, Minnesota, and said line there terminating; AND the drainage and <br />utility easements dedicated in LAKES ADDITION NO. 1, Anoka County, Minnesota, <br />lying in Lots 1, 2, 3, 4, 5, and 6, Block 1, and Lots 1, 2, 3, 4, 5, 6, 7, 8, and 9, Block 2, <br />and Lots 1 and 2, Block 3, said LAKES ADDITION NO. 1.” <br />
