A two-year warranty bond shall be provided prior to <br />acceptance of storm sewer improvements by the City to ensure the quality of construction. <br />6.6 Landscaping <br /> <br />Final landscaping plans shall be submitted with the final plat for each phase of the <br />Development. They will be consistent with the Plans and will include species, location, size, and <br />type of tree to be planted in such phase. The Developer shall install street trees, as shown on the <br />Plans, which shall be located in accordance with approved PUD Landscape Plan. A letter of <br />credit or cash escrow in an amount to cover the City’s financial risk for the phase being <br />developed, separate from the Financial Guarantee for street and utility work within that phase, <br />will be submitted regarding the landscaping work, subject to the reasonable approval of the City <br />engineer. The letter of credit or cash escrow shall be reduced as Developer completes the <br />required landscaping within such phase as may be permitted by Section 6.9(d) hereof. <br /> <br />6.7 Street Lighting and Signs <br /> <br />For each phase of development, Developer shall submit a street lighting plan (as drafted <br />by Connexus and approved by the City). Developer shall establish an escrow with the City for <br />street light installation and the payment of 15 months of street light maintenance and energy <br />costs at the current rate as determined by the utility provider. A street sign plan will be provided <br />by Developer with the final plat of each phase of the Development. Street signs, for both public <br />and private streets, shall be designed in accordance with City Standard Specifications. Traffic <br />control and street signs shall be paid for by the Developer but installed by the City. Developer <br />shall establish a cash escrow with the City for acquisition and installation of signs, which shall <br />be used as street light work is done. <br /> <br />6.8 Surface Water Reuse – Irrigation System <br /> <br />a. Developer shall design and, install at its own expense an irrigation system for the <br />townhome area and the I-35E berm that utilizes the surface water as the primary source <br />for the irrigation water. Said system shall be operated and maintained by the <br />Development’s homeowners association. <br />b. The City shall irrigate the Public Park utilizing the surface water as the primary source <br />for the irrigation water. The City shall design and install its own irrigation system in all <br />Public Parks. <br /> <br />6.9 Security for Completion of Work in Plans and Subdivision Improvements <br /> <br />a. The Developer shall fully and faithfully comply with the terms of this Agreement and <br />phase-specific Development Agreements. The Developer will furnish to the City a cash <br />deposit, certified check, or Irrevocable Letter of Credit, based on one hundred fifty (150%) <br />percent of the total estimated cost of Developer's obligations under this Agreement, on a <br />phase by phase basis as determined by the City. For the phase of Development that will <br />include the Public Park and Outlot E, the Security shall include (but not be limited to) <br />security for the cost of grading the Public Park and the lake, identified as Outlot E, in the <br />approved Preliminary Plat to assure that it may be integrated into the City’s stormwater
