<br />{00149157 12} 18. <br />Article IX Club House <br /> <br />9.1 Site Plan Approval <br /> <br />The Developer shall construct a private club house for the use of the residents of the <br />Development once 518 building permits have been issued for the Project. Outlot I of the <br />Preliminary Plat has been identified as the location by the Developer on the Plans and is <br />generally acceptable to the City. Formal approval will be granted through a site plan review at <br />the time the Developer constructs the club house. Although the City retains its full legal <br />discretion with regard to review of the plan for the club house, approval by the City will not be <br />unreasonably withheld, conditioned or delayed if plans for the private clubhouse are consistent <br />with the Plans, as shown in Exhibit D, page 27, HOA Center Concept. The private clubhouse <br />shall be for the sole use of residents of the Development who are members of the Homeowners <br />Association created by Developer. <br /> <br />Article X Fees and Credits; Payment Phasing <br /> <br />10.1 Trunk Sewer Connection Fees <br /> <br />The City has established trunk utility connection fees to uniformly distribute the <br />costs of public trunk sanitary sewer infrastructure. The Trunk Sewer Connection <br />Fee consists of two components; a Trunk Charge and an Availability Charge. <br /> <br />Trunk Charge <br /> <br />The trunk charge for a particular phase shall be paid at the time of subdivision <br />approval of that phase. The present trunk sewer charge is $1,505.00 per unit, but <br />Developer acknowledges the City adjusts the charge annually, and Developer is <br />responsible for payment of per unit fee in place at the time of approval of a <br />particular phase. <br /> <br />Availability Charge <br /> <br />For residential properties, the availability charge shall be paid at the time of <br />subdivision approval of a particular phase. Fees are based on the number of <br />sanitary access charge (SAC) units assigned by Metropolitan Council <br />Environmental Services (MCES). Residential uses shall be assigned one unit per <br />dwelling unit unless otherwise noted by MCES. The present availability is $1,408 <br />per unit, but Developer acknowledges the City adjusts the charge annually, and <br />Developer is responsible for payment of the per unit fee in place at the time of <br />approval of a particular phase. <br />Trunk sewer unit charges addressed under this paragraph are in addition to any <br />SAC charges imposed by Metropolitan Council Environmental Services.
