ORDINANCE NO. 24 <br /> n THE VILLAGE OF LINO LAKES <br /> AN ORDINANCE REPEALING ORDINANCE NO. 15 OF THE VILLAGE OF LINO LAKES, <br /> ESTABLISHING THE OFFICE OF FIRE MARSHALL AND REGULATING THE STARTING <br /> OF GRASS FIRES, THE BURNING OVER OF LAND, AND THE BURNING OF RUBBISH ' <br /> AND COMBUSTIBLE MATERIALS, AND FIXING PENALTIES FOR THE VIOLATION THEREOF. <br /> The Village Council of the Village of Lino Lakes does ordain: <br /> SECTION 1. It shall be unlawful for any person, firm or corporation <br /> to burn rubbish, trash, paper, or other combustible materials in the <br /> Village of Lino Lakes, except between the hours of 5 o'clock P.M. and <br /> 9 o'clock P.M. on Mondays thru Fridays of each week and between the hours <br /> of 7 o'clock A.M. and 9 o'clock P.M. on Saturdays, Sundays, and holidays, <br /> without first procuring from the Fire Marshall of said Village or his <br /> authorized deputy, a permit for so doing. Combustible materials shall <br /> be burned during the authorized hours, only within a safely constructed <br /> burner or similar device which will confine the burning particles. No <br /> such burner shall be placed within 15 feet of any flammable material , <br /> building or structure. <br /> SECTION 2. No ashes, smoldering coals, embers, greasy or oily <br /> substances, nor other matter subject to spontaneous combustion shall be <br /> deposited within 10 feet of any wooden or plastered wall , partition, <br /> fence, floor, lumber, hay,shavings, rubbish or other combustible materials <br /> except in metallic or other non combustible receptacles. Such non con- <br /> bustible receptacles, unless resting on the ground outside the building, <br /> shall be placed on non combustible stands, and in every case shall be <br /> kept at least two (2) feet away from any wall or partition. <br /> SECTION 3. It shall be unlawful for any person, firm or corporation <br /> to start any grass firing in the Village of Lino Lakes, or burn over any <br /> lot, piece or parcel of land in said Village, or cause, permit or allow <br /> the same to be done, without first procuring from the Fire Marshall of <br /> said Village, or his authorized deputy, a permit for so doing. <br /> SECTION 4. All burning permits ahall fix the time when and state <br /> the conditions under which said burning shall be done. Except as here- <br /> inbefore provided, it shall be unlawful for any person , firm or corpora- <br /> tion to set, maintain or kindle a fire contrary to the conditions set <br /> forth In said permit. or at any time other than stated in said permit. <br /> SECTION 5. No parent shall permit, authorize, or allow a minor <br /> child to perform any act prohibited to Section ; . 2. or 3, hereof. <br /> SECTION 6. The Village Council shall appoint a Fire Marshall , The <br /> Fire Marshall shall be given the authority and the responsibility to <br /> enforce all the provisions of this ordinance under the direction of the <br /> Village Council . Any person, or persons, who shall interfere with the <br /> Fire Marshall and the execution of his duties shall upon conviction <br /> thereof be subject to the penalties provided herein. The Fire Marshall <br /> is given the authority to call upon the Constables for assistance in <br /> enforcing any of the provisions of this ordinance. The term of office <br /> for the appointed Fire Marshall shalt be Indefinite and shall terminate <br />
