ORDINANCE NO. 21 A VILLAGE OF LINO LAKES, MINNESOTA AN ORDINANCE AMENDING ORDINANCE NO. 21, OF THE VILLAGE OF LINO LAKES, ANOKA COUNTY, MINNESOTA PASSED BY THE VILLAGE COUNCIL ON OCTOBER t4, 1957, ENTITLED: "AN ORDINANCE ESTABLISHING REGULATIONS FOR THE SUBDIVISION AND PLATTING OF LAND WITHIN THE VILLAGE OF LINO LAKES" by adding thereto the following: 3 SECTION in A The Village Council of the Village of Lino Lakes, Anoka County, Minnesota, ordains: Ordinance No. 21, passed by the Village Council of the Village of Lino Lakes on October, .4, 1957, is hereby amended by adding thereto the following: SECTION lig A. PLATTING REQUIRED. Pursuant to the allowances of M.S.A. 471.29, subd 2, no conveyance of land in which the land conveyed is described by metes and bounds or by reference to a plat hereafter made, which is not approved by the Village Council in the Village of Lino Lakes, shall be made or recorded if the parcel described in the conveyance is less than two and one half (2 and 2) acres in area and One hundred fifty (150) feet in width, unless such parcel was a separate parcel of record at the time of the adoption of this ordinance or unless an agreement to convey such smaller parcel has been entered into prior to such time and the instrument showing the agreement to convey is recorded in theoffice of the Register of Deeds w.thin one year thereafter. In any case in which compliance with the foregoing provision will involve an urcessary hardship and failure to comply does not interfer with the purpose of such platting regulations, the Village Council of Lino Lakes may waive such compliance by adoption of a resolution to that effect with the consent of the Board of Zoning, and the conveyance may ten be recorded. Any owner or agent of the owner of land who conveys a lot or parcel in violation of the foregoing provision shall forfeit and pay to the municipality a penalty of not less than $100.00 for each lot or parcel so conveyed. No building permit shall be issued for construction or alteration of any building or structure on any parcel of land which does not comply with the foregoing. Save for above amendment, Ordinance No. 21 shall remain in full force and effect as passed.
