ORDINANCE NUMBER 21-A . <br />'727 Ices <br />AN ORDINANCE AMENDING ORDINANCE NO. 21 OF THE VILLAGE OF LINO LAKES, <br />ANOKA COUNTY, MINNESOTA, PASSED BY THE VILLAGE COUNCIL ON OCTOBER 14, <br />1957, ENTITLED: "AN ORDINANCE ESTABLISHING REGULATIONS FOR THE SUB- <br />DIVISION AND PLATTING OF LAND WITHIN THE VILLAGE OF LINO LAKES" BY <br />ADDING THERETO THE FOLLOWING" <br />SECTION 3-A <br />The Village Council of the Village of Lino Lakes, Anoka County, <br />Minnesota, ordains: <br />Ordinance No. 21, passed by the Village Council of the Village of <br />Lino Lakes on October 14, 1957, is hereby amended by adding thereto <br />the following: <br />SECTION 3-A PLATTING REQUIRED <br />Pursuant to the allowances of M.S.A. 471.29, Subd. 2, no conveyance <br />of land in which the land conveyed is described by metes and bounds <br />or by reference to a plat hereafter made, which is not approved by the <br />Village Council in the Village of Lino Lakes, shall be made or re- <br />corded if the parcel described in the conveyance is less than two and <br />one-half (22) acres in area and one hundred fifty (150) feet in <br />width, unless such parcel was a separate parcel of record at the time <br />ofthe adoption of this ordinance or unless an agreement to convey <br />such smaller parcel has been entered into prior to such time and the <br />instrument showing the agreement to convey is recorded in the office <br />of the Register of Deeds within one year thereafter. In any case <br />in which compliance with the foregoing provision will involve an <br />unnecessary hardship and failure to comply does not interfere with <br />the purpose of such platting regulations, the Village Council of <br />Lino Lakes may waive such compliance by adoption of a Resolution to <br />that effect with the consent of the Board of Zoning, and the con- <br />veyance may then be recorded. Any owner or agent of the owner of <br />land who conveys a lot or parcel in violation of the foregoing pro- <br />vision shall forfeit and pay to the municipality a penalty of not <br />less that One Hundred Dollars ($100.00) for each lot or parcel so <br />conveyed. No building permit shall be issued for construction or <br />alteration of any building or structure on any parcel of land which <br />does not comply with the foregoing. <br />Save for above amendment, Ordinance No. 21 shall remain in full force <br />and effect as passed. <br />This Ordinance shall be in full force and effect from and after its <br />passage and publication according to law. <br />Passed this 27th day of September, 1965. <br />/s/ Alden E.
