9. If a time limit or periodic review is included as a condition by <br /> which a special use permit is granted, the special use permit <br /> �.y shall be reviewed at a public hearing with notice of said hearing <br /> published at least ten (10) days prior to the review; it shall <br /> be the responsibility of the Clerk to schedule such public hear- <br /> ings and the owner of land having a special use permit shall not <br /> be required to pay a fee for said review. <br /> 5.05 VARIANCES AND APPEALS <br /> Where there are practical difficulties or unnecessary hardships in any <br /> way of carrying out the strict letter of the provisions of this ordinance, <br /> an appeal may be made and a variance may be granted. The hardships or <br /> difficulties must have to do with the characteristics of the land and <br /> not the property owner. The procedure for granting variances is as <br /> follows: <br /> (A) A person desiring a variance shall fill out and submit to the Clerk <br /> a "Zoning Form" , together with a fee as required in Ordinance No. 52 <br /> and all related material as requested in Section 5.03. <br /> (B) The application shall be referred to the Planning Commission which <br /> shall submit a report to the Village Council. _ <br /> (C) The petitioner shall appear before the Planning Commission in order <br /> to answer questions. <br /> (D) The Village Councilmay grant the variance if it finds that a hard- <br /> ship has been created by the shape or condition of the parcel in <br /> question, granting the variance is necessary to the reasonable use <br /> of the land and granting the variance will not adversely affect the <br /> existing or potential use of adjacent land. <br /> Section 6. DISTRICT PROVISIONS <br /> 6.01 DISTRICTS <br /> The zoning districts are so designed as to assist in carrying out the <br /> intents and purposes of the Comprehensive Plan and to control residential <br /> densities in such a manner as to adequately provide public services and <br /> utilities. The zoning districts are based upon the Comprehensive Plan <br /> which has the purpose of protecting the public health, safety, conven- <br /> ience, and general welfare by controlling the needs for public utilities, <br /> protecting against traffic congestion and accident hazards, protecting <br /> the public health from adverse influences generated by non-residential <br /> uses, protecting against the danger of fire conflagration, and other <br /> purposes of a similar nature. <br /> For the purposes of this Ordinance the Village of Lino Lakes is hereby <br /> divided into the following Zoning Districts. <br /> -17- <br />
