use and structures as they existed on said date and any enlargement, <br /> structural alteration, or intensification of use shall require an <br /> 100 <br /> 1 amended special use permit as provided for above. <br /> Certain uses, while generally not suitable in a particular zoning <br /> district, may, under some circumstances be suitable. When such <br /> circumstances exist, a special use permit may be granted. Conditions <br /> may be applied to issuance of the permit and a periodic review of the <br /> permit may be required. The permit shall be granted for a particular <br /> use and not for a particular person or firm. The cancellation of a <br /> special use permit shall be considered administratively equivalent to <br /> a rezoning, and the same requirements and procedures shall apply. <br /> (B) Procedure <br /> 1. The person applying for a special use permit shall fill out and <br /> submit to the Clerk a "Zoning Form" together with a fee as required <br /> in Ordinance No. 52 and all related material as requested in <br /> Section 5.03. <br /> 2. The Clerk shall refer the application to the Planning Commission. <br /> Property owners within 300 feet of the property in question shall <br /> be notified, although failure of any property owner to receive <br /> such notification shall not invalidate the proceedings. <br /> 3. The Planning Commission shall consider the petition at its next <br /> regular meeting, but not earlier than ten days from date of sub- <br /> mission to the Planning Commission and in accordance with <br /> Section 5.03. <br /> 4. The petitioner or his representative shall appear before the <br /> Planning Commission in order to answer questions concerning <br /> the proposed special use. <br /> 5. The report of the Planning Commission shall be placed on the <br /> agenda of theVillage Council at its next regular meeting following <br /> referral from the Planning Commission but not later than 90 days <br /> after the applicant has submitted the application. <br /> 6. TheVillage Council must take action on the application within 60 <br /> days after receiving the report of the Planning Commission. If <br /> it grants the special use permit the Village Council may impose <br /> conditions (including time limits) it considers necessary to <br /> protect the public health, safety and welfare, and such conditions <br /> may include a time limit for the use to exist or operate. <br /> 7. An amended special use permit application shall be administered <br /> in a manner similar to that required for a new special use permit <br /> except that the fee shall be five dollars ($5.00) ; amended <br /> special use permits shall include re-applications for permits <br /> that have been denied, requests for changes in conditions, and <br /> as otherwise described in this ordinance. <br /> ,-� 8. No application for a special use permit shall be re-submitted for <br /> a period of twelve (12) months from the date of said order of denial. <br /> -16- <br />
