provided, all proceedings shall be conducted according to <br />the provisions of Minnesota Statutes Sections 15.0424 - <br />15.0426. <br />Subd. 7. The Court may affirm the decision of the <br />hearing panel or remand the case for further proceedings; <br />or it may reverse or modify the decision if the substantial <br />rights of the appellant have been prejudiced because the <br />hearing panel's findings or conclusions are: <br />(a) In violation of constitutional provisions; or <br />(b) In excess of the authority conferred upon said <br />hearing panel by this ordinance; or <br />(c) Made upon unlawful procedures; or <br />(d) Affected by other error of law; or <br />(e) Unsupported by substantial evidence in view <br />of the entire record as submitted; or <br />(f) Arbitrary or capricious. <br />Section 13. STANDARDS FOR DETERMINING ALLOWABLE <br />RETURN ON COMMON EQUITY. The Allowable Return on Common Equity <br />is determined by and must satisfy the following standards: <br />(a) The Allowable Return on Common Equity shall <br />permit Company to earn a return on its equity <br />investment in property which it employs for <br />the convenience of the public equal to that <br />generally being made at the same time and in <br />the same general part of the country on similar <br />investments in other business undertakings <br />20 <br />
