The developer must return for a special use permit <br />before a building permit may be obtained in a commercial area without sewer <br />All Building plans and site plans must be approved before any developing cG <br />be done. <br />Mr. Tschida was asked the plans for the area and he said they are looing for <br />owners - they sell lots - they sometime consturct building and lease. He <br />also has the land across 24th Avenue in Hugo for sale and they are not asking <br />for any to participate in the upgrading of 24th. <br />The matter of a portion being rezoned to general business and a portion to <br />light Industrial was questioned and Mr. Tschida said it was done in order <br />to attract different types of businesses. There was discussion of moving <br />the area designated as general business from the East side of the area to <br />the West but Mr. Locher said the area designated as general business could <br />not be considered for light industrial at this hearing - it is permissable <br />to zone down but not up. <br />Mr. McLean moved to deny this rezoning. Mr. Tschida objected in that he <br />felt that he must wait a year before reapplying - Mr. McLean said, not if <br />he returned with a different layout. Mr. Zelinka suggested the entire North <br />portion be rezoned to General Business with a rezoning application for the <br />East half at a later date. <br />Mr. McLean's motion died for lack of a second. Mr. Zelinka moved to rezone <br />the North 468.6 feet of the W# of the SE' of the NE3 of Section 24 to <br />General Business and the Wof the SEA of the NE -I except the North 468.E <br />feet thereof to Light Industrial. Seconded by MR. McLean. Motion declared <br />passed. <br />Mr. Zelinka moved to deny the zoning on Block 3 of the plat. Seconded by <br />Mr. Schneider. Motion declared passed. <br />Mr. McLean moved to close the hearing at 10:15 P.M. Seconded by MR. Zelinka. <br />ijMotion declared passed. <br />Mr. Locher reported that the matter of Mr. Donald Holzmer's home had been <br />completed. A11 that is necessary is the variance to the ceiling height in <br />the basement area. This can be done by variance. <br />Mr. McLean moved to grant a variance for the difference in height requirement <br />for the basement area, this variance to be filed with the County Recorder <br />to become a part of the abstract. Seconded by MR. Zelinka. Motion declared <br />passed. <br />The Forest Tagg matter is scheduled for trial Wednesday, December 12, 1979 <br />at 10:30 A.M. <br />Mr. Locher reproted that he had delived the transcripts of the minutes to <br />the bond Attorney. There are a few minor details to be completed, but these <br />must wait for a delvier date. <br />Mr. Locher had checked the Letter of Agreement from the Metropolitan Waste <br />Control Commission and had found only one area that he questioned. This wa. <br />the area of repairs being done by the City on the MWCC equipment. The City <br />would be reimbursed on a 50/50 basis.
