p?cng and Zoning <br />.----'-F,; bruary 18( 1981 <br />The regular meeting of the Lino Lakes Planning and Zoning Board was <br />called to order at 7:30 P.M., February 18, 1981, by Chairman Bathke. <br />Members present; Klaus, Johnsen, Doocy, Prokop. Absent; Johnson. <br />Mr. Bathke noted that there is a quorum present but not a 2/3's majority. <br />The minutes of Jan. 7, 1981 special meeting were considered. Mr. Doocy <br />moved to approve. Seconded by Mr. Prokop. Motion carried. <br />Mr. Prokop moved to approve the minutes of January 21, 1981 as presented. <br />Seconded by Mrs. Klaus. Motion carried. <br />Mr. Schumacher reported on the actions of the Council actions on Jan. 26, <br />198I noting that a Resolution had been forwarded to the Metropolitan <br />Council in conjunction with the submission of the Comprehensive Plan for <br />review. <br />Mr. Prokop asked the status of the court action in conjunction with the <br />proposed quads and Mr. Schumacher said at the present time he has not <br />heard of any further action at this point in time. <br />The first item on the agenda was a request for a rezone as submitted by <br />Mr. Glenn Rehbein. Mr. Harvey Karth represented Mr. Rehbein. Mr. <br />Rehbein had also submitted a variance request and since there is not a <br />2/3's majority to vote on a rezone, Mr. Bathke suggested considering the <br />variance first. <br />This variance is for the splitting of the land that had been vacated as <br />park lands in Shenandoah I. This would split that parcel of land into <br />two lots each with more than the required square footage. Mr. Prokop <br />moved to recommend approval of this variance for the lots splits per the <br />survey of December 30, 1980.Seconded by Mr. Doocy. Motion carried. <br />Mr. Johnson arrived. <br />li considering the rezone request, the Board took some time to read the <br />comments from Mr. Meister and Mr. Short they had just received this <br />evening. - <br />Mr. Bathke asked Mr. Karth what the company's reaction was to Mr. Short's <br />letter, particularly in the area of crossing the creek. Mr, Karth said <br />they had pulled the cul-de-sac back to the South of the Creek. <br />Mr. Johnson questioned the use of the land of as HI at the present time - <br />has there been a special use permit issued? Mr. Schumacher said that this <br />use had been approve administratively- there had not been a special use <br />permit issued. Mr. Johnson asked if this property is currently under <br />litagation and Mr. Karth said, yes, a civil action. <br />The points set forth in both Mr. Short's and Mr. Meister's letters of <br />reviewed were discussed. <br />Mr. Doocy moved to recommend approval of the rezone of the Glenn Rehbein <br />proposal for LI, to include Lots 1 through 11, according to the sketch <br />1 <br />
