AFFIDAVIT OF PUBLICATION STATE OF MINNESOTA 1SS COUNTY OF WASHINGTON TY OF LINO LAKES Council Member Neal introduced the follow- ing resolution and moved its adoption: CITY OF LINO LAKES RESOLUTION 96-151 RESOLUTION RECEIVING REPORT .AND CALLING HEARING ON IMPROVEMENT. WHEREAS, pursuant to resolution of -council adopted October 28, 1996, a report been prepared by TKDA, Inc., with ref- erence to the improvement of Otter Lake Service Road between Phelps Road and re- d Otter Lake Road by constructing street, curb and gutter, storm sewer, water - Maui and sanitary sewer, and this report was received by the council on November 25, 1996. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO LAKES, MINNESOTA: 1. The council will consider the improve- ment of such street in accordance with the reeportand the assessment of abutting proper- ty for all or a portion of the cost of the improvement pursuant to Minnesota Statutes, Chapter 429 and the Section 8 of the Lino Lakes City Charter at anestimated cost of the improvement of $350,700.00. 2. A public hearing will be held on such proposed improvement on the 16th day of December, 1996, in the council chambers of the city hall at 6:30 p.m. and the clerk shall give mailed and published notice of such hearing and improvement as required by law. Anderson Clerk -Treasurer The motion of the adoption of the forego- ing resolution was duly seconded by Council Member Bergeson and upon vote being taken thereon, the following voted in favor thereof: Bergeson, Neal, Landers. The following voted against same: Lyden and Kuether were absent. Whereupon said resolution was declared passed and adopted.
