(B) No pumps, filter or other apparatus used in connection with <br />or to service a swimming pool shall be located less than <br />fifty (50) feet from any lot line. <br />(C) The pool area shall be adequately fenced to prevent <br />uncontrolled access from the street or adjacent property. <br />Adequate screening, including but not limited to land- <br />scaping, shall be placed between the pool area and adjacent <br />lot lines. <br />(D) All deck areas, adjacent patios, or other similar areas used <br />in conjunction with the swimming pool shall be located at <br />least thirty (30) feet from any lot line. <br />(E) To the extent possible, back -flush water or water from pool <br />drainage shall be directed onto the owner's property. <br />(F) The filter unit, pump, heating unit and any other noise - <br />making mechanical equipment shall be located at least fifty <br />(50) feet from any adjacent or nearby residential structure <br />and not closer than ten (10) feet to any lot line. <br />Subd. 31. Drainage. No land shall be developed or altered and no use <br />shall be permitted that results in surface water runoff causing unreasonable <br />flooding, erosion or deposit of minerals on adjacent properties or waterbodies. <br />Such runoff shall be properly channeled into a storm drain, a natural water course <br />or drainageway, a ponding area or other public facility. <br />The zoning official, upon inspection of any site which has created <br />drainage problems or could create drainage problems with proposed new develop- <br />ment, may require the owner of said site or contractor to complete a grading plan. <br />The owner or contractor of any natural drainage improvement or <br />alteration may be required by the zoning official to obtain recommendations from <br />the Minnesota Department of Natural Resources, the Soil Conservation District, <br />affected Watershed District(s), and/or community engineer(s). <br />On any slope in excess of twelve percent (12%) where, in the opinion of <br />the zoning official, the natural drainage pattern may be disturbed or altered, the <br />zoning official may require the applicant to submit both a grading plan and a soil <br />conservation plan prior to applying for a Building Permit. <br />Subd. 32. Land Reclamation and Land Grading. Within this Ordinance, <br />land reclamation is the reclaiming of land by depositing or moving material so as to <br />alter the grade. Land reclamation shall be permitted by Conditional Use Permit in <br />all districts. Depositing a total of more than fifty (50) cubic yards of material per <br />acre, either by hauling in or regrading the area, shall constitute land reclamation. <br />Land reclamation in floodplains shall be in accordance with the Floodplain <br />Ordinance. The permit shall include as a condition thereof a finished grading plan <br />which will not adversely affect the adjacent land and as conditions thereof shall <br />regulate the type of material permitted, program for rodent control, plan for fire <br />control, and general maintenance of the site, controls of vehicular ingress and <br />egress, drainage and control of material disbursed from wind or hauling of material <br />to or from the site. <br />32 <br />
