No water area shall be filled, partially filled, dredged, altered by <br />grading, mining or otherwise utilized or disturbed in any manner without first <br />securing a permit from the Minnesota Department of Natural Resources, the U.S. <br />Army Corps of Engineers, and the affected Watershed District Board. Such grading <br />may be reviewed and approved by the Department of Natural Resources, the <br />Community Engineer, the Watershed District and the Planning Commission. <br />Water areas shall include all lakes, ponds, swamps, streams, drainage - <br />ways, floodplains, floodways, natural water courses, underground water resources <br />and similar features involving directly or indirectly the use of water within the <br />community. <br />Subd. 33. Farming Operations. All farms in existence upon the <br />effective date of this Ordinance and all farms which are brought into the city by <br />annexation shall be a permitted use. All dwelling units and structures for <br />processing of farm goods shall require a building permit and conform to all <br />requirements of the building code. The City Council may require any new farm <br />operation to secure a Conditional Use Permit in the event of the following: <br />(1) The farm is adjacent to or within four hundred (400) feet of any <br />dwelling unit and may be detrimental to living conditions by <br />emitting noise, odors, vibrations, hazards to safety, and the like. <br />(2) The farming operations are so intensive as to constitute an <br />industrial type use consisting of the compounding, processing, and <br />packaging of products for wholesale or retail trade and further <br />that such operations may tend to become a permanent industrial <br />type operation that cannot be terminated as can a normal farming <br />operation. <br />Subd. 34. Metes and Bounds Conveyances - Building Permits. Building <br />Permits. No building permit shall be issued for any parcel conveyed by a metes and <br />bounds description unless the following conditions have been complied with, and <br />unless the approval of the City Council has been obtained. <br />(1) The applicant shall complete an application for building permit, <br />on forms to be prepared by the zoning officer. The applicant shall <br />be required to supply the following information: <br />(A) The proposed legal description, unless this requirement be <br />waived by the zoning official. <br />(B) A sketch of the proposed conveyance, at a scale of not less <br />than one inch to 200 feet. Said sketch shall also display the <br />following information: <br />(i) An approximate contour line encompassing the area <br />within the proposed conveyance which lies at an <br />elevation at least four (4) feet above the highest water <br />table. <br />(ii) The names and addresses of the property owners with <br />land abutting or having any portion of a parcel lying <br />within one hundred fifty (150) feet of any portion of <br />the proposed conveyance. <br />33 <br />
