(xiii) A Soil Erosion Control Plan acceptable to watershed <br />district, Department of Natural Resources, or any <br />other agency with review authority clearly illustrating <br />erosion control measures to be used during construc- <br />tion and as permanent measures. <br />(G) Processing Fees. At the time of formal application for a <br />PUD, the developer must pay a filing fee to help defray the <br />cost of review. <br />(H) Ownership. A tract of land to be developed as a planned <br />unit development shall be under the control of: <br />(i) A single owner; or <br />(ii) A group of landowners, acting through a corporation, <br />where each owner agrees in advance to be bound by <br />the conditions and regulations which will be effective <br />within the district and to record such covenants, <br />easements, and other provisions with the county <br />registrar of deeds. <br />(I) Enforcement. If no construction has begun in the PUD <br />within 12 months from the approval of the PUD and <br />recording of documents, said approval shall lapse and be of <br />no further effect. The Planning Commission, upon showing <br />of good cause by the developer, may extend for period(s) of <br />12 months, the time for beginning construction. <br />(4) Substantive Criteria for Review and Approval. <br />(A) Density. The average density of the PUD shall not be <br />greater than that which applies to the existing zone where <br />the PUD is proposed as established in this ordinance. <br />(B) Minimum Parcel Size. The area of the land to be developed <br />shall not be less than 5 acres. <br />(C) Open Space. A minimum of 10 percent of the total project <br />area shall be reserved for active recreation (areas large <br />enough to be suitable for active play). <br />(i) A minimum of 35 percent of the total project area <br />shall be reserved as open space (green area). (Active <br />recreational areas may be used in meeting open space <br />requirements.) <br />(ii) All common open space, at the election of the city, <br />shall be: <br />Conveyed to the city or conveyed to a not -for -profit <br />corporation or entity established for the purpose of <br />benefiting the owners and residents of the planned <br />development or adjoining property owners or any one <br />or more of them; or <br />73 <br />
