October 5, 1978 <br />- Page Two - <br />Mr. Zelinka discussed whether this community should be contiguous or not - <br />' the nearer ones with the same problems or one farther away with different <br />probelms. It was felt that 4 community not so near,as to share the same <br />border, but yet in the same County with the same form of government. <br />The matter of the Open Meeting Law was discussed in relationship with the <br />consulting of a Council member and an administrator and Mr. Pass said this <br />does not apply to a person .ih that position. He felt if the Council needed <br />expert advice, Mr. Phil Cohen, 561-4133 or 291-6959, could assisst them. <br />Mr. Schneider said he had done quite a bit of work in the area of this <br />position and would asked the Council permission to continue. The consensus <br />of the Council was that Mr. Schneider should continue this research. <br />Mr. Schneider said:he had contacted the League of Minnesota Cities and they <br />had requested a copy of the job description for the Clerk -Treasurer. This <br />has been mailed along with a copy of the duties of the Deputy Clerk. Mr. <br />Bush will have information Pack to Mr. Schneider for the last meeting in <br />October. <br />Mr. Schneider had prepared an analysis of the 1979 budget to the 1978 budget, <br />this inclueded the anticipaPad income and the expenditures as set forth at <br />the last budget hearing. There are some special levies outside the levy <br />limitation that was computed with the assistance of Mr. Don Anfinson. <br />The matter of deleting 10,000 from the road budget was discussed, This was <br />in the budget to insure repair of streets that could be ruined by a <br />developer who used that street to gain acess to a new plat. <br />Mr. Zelinka felt that ;if a City street is destroyed in such a planner, the <br />developer, should be responsible for the restoration of that street. The <br />City should have ;some assurance that this is the case before the hardshells <br />are signed. P'erhaps the Council should consider an Ordinance in this matter. <br />It was also s ggested that the developer's liability insurance be written <br />to cover this possibility <br />Some of the dedicated' funds tor the Park have been invested in CD's, 90 days <br />at 74% interest. :There w.as.d.iscussion on the use of this interest, should <br />this remain in the dedicates funds or can it be used for general maintenance <br />for the Park syste? The genet 1 feeling of the Council was this could be <br />used for maintenace.
