Planning & Zoning Board <br />June 12, 2019 <br />Page 2 <br />DRAFT MINUTES <br />There was no one present for Open Mike. <br /> <br />Mr. Stimpson made a MOTION to close Open Mike at 6:34 P.M. Motion was supported <br />by Mr. Evenson. Motion carried 6 - 0. <br /> <br />VII. ACTION ITEMS <br /> <br />A. 6626 Enid Trail – Variance for Curb Cub/Driveway Width <br /> <br />Katie Larsen, City Planner, presented the staff report. <br /> <br />Mr. Laden asked why the City is concerned about the property width at the property <br />line rather than the curb. Ms. Larsen stated the ordinance is written as such, creates <br />open space, and private utilities are located in the right of way. <br /> <br />Mr. Ruhland inquired about the escrow funds. Ms. Larsen confirmed the City is <br />holding the funds and a temporary CO was issued. <br /> <br />Mr. Ruhland asked if the driveway is encroaching on the utility easement. There are <br />utilities within boulevard right of way. <br /> <br />Rebecca and Adam Neeck, 6626 Enid Trail, presented to the Planning and Zoning <br />Board. The first 50 feet of the driveway is compliant; from 50 to 60 feet is not in <br />compliance. Mr. Neeck observed two driveways on Sioux Lane and Sioux Lookout <br />that are out of compliance. <br /> <br />Mr. Laden asked if the applicant built the house and if they were a part of the <br />driveway process. Ms. Neeck clarified that they built the home but were not a part of <br />the driveway process. <br /> <br />Mr. Stimpson stated that the Sioux Lane and Sioux Lookout addresses were built <br />when 36 foot wide driveways were allowed. <br /> <br />Mr. Root has trouble approving an ordinance when staff did not find any reasonable <br />findings. His preference would be to revise the ordinance. <br /> <br />Mr. Stimpson asked how a 60 foot right of way ended up on this lot. Ms. Larsen <br />noted that there are other properties in the development with the same situation and <br />have compliant driveways. <br /> <br />Ms. Larsen clarified approval of the variance would allow for the current driveway to <br />remain in place and the ability, in the future, to reconstruct as is. <br /> <br />Mr. Ruhland asked when the driveways, with the same situation and are compliant, <br />were installed. <br />
