Planning & Zoning Board <br />June 12, 2019 <br />Page 3 <br />DRAFT MINUTES <br />Kari Clark, Sharper Homes, 14840 Aberdeen Street, Ham Lake, reiterated the <br />sequence of events with the builder and homeowner. <br /> <br />Ms. Peacock and Mr. Evenson stated they would like builders to keep to the <br />ordinance and hold builders accountable. <br /> <br />Mr. Laden made a MOTION to approve the denial of 6626 Enid Trail-Variance for <br />Curb Cut/Driveway Width. Motion was supported by Mr. Evenson. Motion carried 6- <br />0. <br /> <br />B. 6650 Enid Trail – Variance for Impervious Surface Coverage <br /> <br />Katie Larsen, City Planner, presented the staff report. <br /> <br />Kari Clark, Sharper Homes, 14840 Aberdeen Street, Ham Lake, explained that <br />previous Sharper Homes houses, within the development, were built out of <br />compliance. The issue was brought to their attention in May of 2019. Development <br />wide, Sharper is in compliance. They are out of compliance on a lot by lot basis. <br /> <br />Mr. Stimpson asked if there are ramifications for the existing properties that are over <br />the 30%. Staff confirmed that the City was applying the 40% and this application, <br />over the 40%, was a red flag being that it violates the variance guidelines. <br /> <br />Mr. Ruhland stated it is a large gap. Ms. Clark clarified the purpose of the rain <br />garden. <br /> <br />Mr. Laden stated he has seen deprivation of the waterways over the years. He is <br />disappointed seeing the City allow encroachment on the shoreland overlay district <br />and not taking care of the issue from the start. <br /> <br />Mr. Root stated it is a large variance in a sensitive area and the environmental impact <br />is too large. <br /> <br />Chair Tralle stated 13% is a large number; 1-2% allows for some leeway. <br /> <br />Mr. Root made a MOTION to approve the denial of 6650 Enid Trail-Variance for <br />Impervious Surface Coverage. Motion was supported by Stimpson. Motion carried 6- <br />0. <br /> <br />C. 1393 Hunters Rudge – Variance for Curb Cut/Driveway Width <br /> <br />Katie Larsen, City Planner, presented the staff report. <br /> <br />Mr. Ruhland asked what the ordinance was when the house was built. Mr. Grochala <br />stated the ordinance changed in 1998 to allow for 36 feet wide driveways. The
