AMENDMENT TO DEVELOPMENT AGREEMENT and PLANNED UNIT DEVELOPMENT AGREEMENT NorthPointe 7th Addition <br />THIS AMENDMENT is entered into on ________ day of ____________, 2019, by the City of Lino Lakes (“City”), and Tony Emmerich Construction, Inc., a Minnesota corporation (“Developer”), Parties to the Development Agreement and Planned Unit Development Agreement NorthPointe 7th Addition dated June 12, 2018 which is attached as Exhibit A. <br /> <br /> RECITALS WHEREAS, the NorthPointe 7th Addition Development includes a portion of trail to be installed <br />by the City and it is cost effective to have the Developer complete the work in coordination with <br />their other site work. The trail location is detailed in Exhibit B; and WHEREAS, the developer shall install the trail to meet the City’s General Specifications and Standard Detail Plates for Street and Utility Construction dated February 2018: and <br /> <br />NOW, THEREFORE, BE IT RESOLVED the Development Agreement and Planned Unit Development Agreement NorthPointe 7th Addition dated June 12, 2018 section 16a is amended to provide for reimbursement of park dedication for trail improvements constructed by the Developer in the estimated amount of $25,845.00 based on the bid proposal from C. W. Houle, <br />Inc. dated January 24, 2019. Reimbursement to the Developer shall be the actual construction <br />costs. Reimbursement shall be made within 30 days upon receipt of a lien waiver from the Developer as proof of payment to the Contractor.
