Consider Resolution No. 19-65, Authorizing <br />Acquisition of Real Property by Eminent Domain, <br />NE Lino Lakes Drainage Area Improvement Project <br /> <br />VOTE REQUIRED: 3/5 <br /> <br />INTRODUCTION <br /> <br />Staff is requesting City C ouncil approval of Plans and Specifications and authorization to <br />commence eminent domain proceedings for the NE Lino Lakes Drainage Area Improvement <br />project. <br /> <br />BACKGROUND <br /> <br />On June 27, 2016, the City Council accepted the feasibility study for the Northeast Drainage <br />Outlet to Peltier Lake. The study analyzed options for providing a surface water outlet for a <br />landlocked area of approximately 1,300 acres. <br /> <br />In November of 2017, the City Council approved the NE Area Comprehensive Stormwater <br />Management Plan (CSMP) in accordance with Rice Creek Watershed District (RCWD) <br />requirements. On October 22, 2018, the City Council authorized the preparation of plans and <br />specifications for the NE Lino Lakes Drainage Area Improvement Project. <br /> <br />WSB and Associates, City Engineer, has prepared plans and specifications for final submittal to <br />permitting agencies. <br /> <br />As previously presented to the City Council, construction of the project requires the land <br />acquisition of fee title, and both permanent and temporary easements. Three properties are <br />effected by the improvement. <br /> <br />State law provides authority for cities to acquire property for public purpose through the use of <br />eminent domain. However, prior to initiation of these proceedings, the City is required to make <br />efforts to acquire the property through direct purchase. <br />The City Council authorized WSB to proceed with offers on the properties at the February 25,
