Consider Resolution No. 19-65, Authorizing Acquisition of Real Property by Eminent Domain, NE Lino Lakes Drainage Area Improvement Project VOTE REQUIRED: 3/5 INTRODUCTION Staff is requesting City C ouncil approval of Plans and Specifications and authorization to commence eminent domain proceedings for the NE Lino Lakes Drainage Area Improvement project. BACKGROUND On June 27, 2016, the City Council accepted the feasibility study for the Northeast Drainage Outlet to Peltier Lake. The study analyzed options for providing a surface water outlet for a landlocked area of approximately 1,300 acres. In November of 2017, the City Council approved the NE Area Comprehensive Stormwater Management Plan (CSMP) in accordance with Rice Creek Watershed District (RCWD) requirements. On October 22, 2018, the City Council authorized the preparation of plans and specifications for the NE Lino Lakes Drainage Area Improvement Project. WSB and Associates, City Engineer, has prepared plans and specifications for final submittal to permitting agencies. As previously presented to the City Council, construction of the project requires the land acquisition of fee title, and both permanent and temporary easements. Three properties are effected by the improvement. State law provides authority for cities to acquire property for public purpose through the use of eminent domain. However, prior to initiation of these proceedings, the City is required to make efforts to acquire the property through direct purchase.
