2 <br />2019 City Council meeting. Offer letters, accompanied with a copy of the property appraisal, <br />where distributed to property owners. WSB and City staff have had continued discussions with <br />the property owners regarding the acquisition.. However, no agreement has been reached with <br />either party. During prior discussions the City Council was advised of the potential need to <br />pursue eminent domain and agreed to move forward with the process at the May meeting. <br /> <br />Appraisals for the property have been updated for each property and reflect modifications to the <br />construction limits based on the final plans. <br /> <br />Below is a summary of the updated acquisition data for each property: <br /> <br />OWNER PID Size Type <br />Leibel 14-31-22-12-0002 <br />(West Parcel) 10.54 Acres Fee Simple <br /> 1.38 Acres Temporary Easement <br />Leibel 14-31-22-14-0001 <br />(South Parcel) 1.65 Acres Permanent Easement <br /> 0.66 Acres Temporary Easement <br />Salo 14-31-22-13-0002 1.59 Acres Fee Simple <br /> <br />Staff will continue to work with property owners to reach an agreement for direct purchase. <br />However, to insure that ongoing property negotiations do not jeopardize the time line for project <br />construction and to ensure the City can meet obligations under the Watermark Master <br />Development Contract it is necessary to commence with eminent domain proceedings. <br /> <br />Through this process the City Attorney will be seeking District Court approval to acquire parcels <br />by eminent domain and establish a possession date. Under the current time line we would <br />anticipate possession by September. There are several steps to this process that will be more <br />fully explained by the City Attorney. <br /> <br />Again, staff is hopeful that all acquisition can be obtained by direct purchase. Staff will continue <br />to negotiate with property owners concurrently throughout the process. <br /> <br />RECOMMENDATION <br /> <br />Staff is recommending approval of Resolution No. 19-64, and Resolution No. 19-65. <br /> <br />ATTACHMENTS <br /> <br />1.
