5 <br />Plan/Preliminary Plat process, the project proposes 0.50 acres of wetland fill requiring <br />1.23 acres of replacement. Permanent wetland impacts are proposed to be replaced <br />through the purchase of wetland bank credits. <br /> <br />Wetland Summary <br />Total Delineated Wetlands 1.62 acres <br />Wetland Fill 0.50 acres <br />WMC Buffer Area 0.84 acres <br />Wetland Mitigation Wetland Bank Credits <br /> <br />A Conservation Easement was recorded over the wetland and greenway corridor/buffer <br />area on October 29, 2019. <br /> <br />Homeowner’s Association <br /> <br />A homeowner’s association is not required by the City. <br /> <br />Development Agreement <br /> <br />A Development Agreement has been drafted by the City and will be executed by the City <br />and the developer and recorded by the developer. <br /> <br />Title Commitment <br /> <br />The City Attorney has reviewed the title commitment and final plat. The title <br />commitment shows North American Banking Company has a mortgage on the property <br />and they shall be listed a signatory on the final plat. A Mortgage Consent is also required <br />from the bank for the Development Agreement. <br /> <br />Stormwater Maintenance Agreement <br /> <br />Under the City’s and RCWD Programmatic Stormwater Management Facility <br />Maintenance Agreement, the City will be responsible for maintenance of the stormwater <br />maintenance facilities. <br /> <br />Rice Creek Watershed District (RCWD) <br /> <br />RCWD issued Permit #17-034 on January 2, 2019. <br /> <br />Findings of Fact-Final Plat <br /> <br />The Findings of Fact are detailed in Resolution No. 19-63. <br />
