Motion carried on a voice vote. 84 <br /> 85 <br />PUBLIC SAFETY DEPARTMENT REPORT 86 <br /> 87 <br />There was no reports from the Public Safety Department. 88 <br /> 89 <br />PUBLIC SERVICES DEPARTMENT REPORT 90 <br /> 91 <br />5A) Consider Resolution No. 19-66, Ordering Project, Approving Plans and Specifications 92 <br />and Authorizing Advertisement for Bid for Well House No. 1 Rehabilitation Project – City 93 <br />Engineer Hankee reported on the recommendation to proceed with actions to move forward on a 94 <br />rehabilitation project for the City’s Well House No. 1. She reported on the type of siding that will be 95 <br />utilized and she indicated that she will report back with before/after pictures. She reported on other 96 <br />elements of the project. 97 <br />Council Member Manthey moved to approve Resolution No. 19-66 as presented. Council Member 98 <br />Rafferty seconded the motion. Motion carried on a voice vote. 99 <br /> 100 <br />COMMUNITY DEVELOPMENT DEPARTMENT REPORT 101 <br /> 102 <br />6A) NE Lino Lakes Drainage Improvement Project: i. Consider Resolution No. 19-64, 103 <br />Approving Plans and Specifications; ii. Consider Resolution No. 19-65, Authorizing 104 <br />Acquisition of Real Property by Eminent Domain- Community Development Director Grochala 105 <br />reported on recommended actions related to this drainage project. He reviewed maps of the proposed 106 <br />drainage area. The current ditch services within the area are antiquated. The drainage project would 107 <br />work to replumb a certain area, bringing water to Lake Peltier. He reviewed previous council actions 108 <br />on the project, including a request for project plans that have now been completed. He noted the 109 <br />private properties impacted and the need for easements and acreage of fee title property (Liebel 110 <br />property and Salo property). Offers have been made on the needed properties but there has been no 111 <br />agreement. Discussions with property owners will not stop with an action authorizing eminent 112 <br />domain and an agreement with the property owners will continue to be pursued. The discussions up 113 <br />to this point have been friendly. Staff recommends approval of the resolutions. The City Attorney is 114 <br />present to answer questions. 115 <br /> 116 <br />Mayor Reinert remarked that eminent domain isn’t something that people do not want to be involved 117 <br />in, especially in this city. Given the fact that there is a timeline involved with this project, the advice 118 <br />the council is receiving is to begin a process they all hate. It’s important to note that negotiations with 119 <br />the property owners are anticipated and expected. Community Development Director Grochala 120 <br />confirmed that this action will give the City a date and time with which they can move forward with 121 <br />the project but discussions will continue and can continue even further. Mayor Reinert remarked that 122 <br />both property owners involved want to sell and the City wants to buy so that is hopeful. 123 <br /> 124 <br />Council Member Stoesz said he is opposed to eminent domain; will there be a final yes/no for the 125 <br />council? City Attorney said the resolution gives the authority to proceed but there is certainly 126
