Site Performance Agreement page 1 of 11 CITY OF LINO LAKES, MINNESOTA SITE IMPROVEMENT PERFORMANCE AGREEMENT THIS AGREEMENT made this _______ day of _______________, 2019, is by and between the City of Lino Lakes, a municipal corporation organized under the laws of the State of Minnesota, and Direct Bore, Inc. (“Developer”). WHEREAS, the Developer has received approval of Site Development Plans, hereinafter called the "Plans", by the City of Lino Lakes on the 14th day of October, 2019, and in accordance with the Plans all of which are made a part hereof by reference. In consideration of such approval, the Developer, its successors and assigns, does covenant and agree to perform the work as set forth in the Plans, in the aforesaid approval, and as hereinafter set forth upon the real estate (hereinafter referred to as "Property") described as follows: PARCEL 1: All that part of the Northeast Quarter of the Northwest Quarter of Section Seventeen (17), Township Thirty-one (31) North, Range Twenty-two (22) West, Anoka County, Minnesota described as follows: Beginning at the Northwest corner of said Northeast Quarter of the Northwest Quarter of Section 17; thence East 0 degrees 00 minutes, along the North line thereof, 160 feet; thence South 0 degrees 00 minutes, 300 feet, thence West 0 degrees 00 minutes, 155.96 feet to the point of intersection thereof with the West line of said Northeast Quarter of the Northwest Quarter; thence North 0 degrees 46 minutes 15 seconds West along said West line, 300.03 feet to the point of beginning, Subject to Lilac Street along the north line thereof. PARCEL 2: All that part of the Northeast Quarter of the Northwest Quarter of Section Seventeen (17), Township Thirty-one (31) North, Range Twenty-two (22) West, Anoka County, Minnesota described as follows: Commencing at the Northwest corner of said Northeast Quarter of the Northwest Quarter of Section 17; thence East 0 degrees 00 minutes, along the North line thereof, 160 feet to the point of beginning; thence continuing East 0 degrees 00 minutes along the North line thereof 72.6 feet,; thence South 0 degrees 00 minutes 300 feet; thence West 0 degrees 00 minutes 72.6 feet, thence North 0 degrees 00 minutes 300 feet to the point of beginning.
