4 <br /> <br />consistent with the establishment of these districts that non-conforming buildings, structures <br />and uses not be permitted to continue without restriction. Furthermore, it is the intent of this <br />section that all non-conforming uses shall be eventually brought into conformity. <br /> <br />(2) Provisions. <br /> <br />(a) Any nonconformity, including the lawful use or occupation of land or premises <br />existing at the time of the adoption of an additional control under this chapter, may be <br />continued, including through repair, replacement, restoration, maintenance, or improvement, <br />but not including expansion, unless: <br /> <br />1. The nonconformity or occupancy is discontinued for a period of more than one <br />year. <br /> <br />This leads to the question as to what should happen with the single family house located in a <br />commercial zoning district guided for industrial use? Community Development Department <br />staff and the City Attorney agreed the single family is a non-conforming use and may be <br />continued as a single family house if compliant with Section 1007.041. Per the applicant’s <br />narrative, “the house would most likely be rented out during this interim”. To verify the house <br />is being occupied and not discontinued for a period of more than one year, the applicant shall <br />keep on record a copy of an executed rental lease agreement. <br /> <br />Zoning and Land Use <br /> <br />The parcels will be rezoned from GB, General Business to LI, Light Industrial to be consistent <br />with the comprehensive plan and surrounding parcels. The LI, Light Industrial District allows <br />for construction-related businesses including contractor storage of equipment and building <br />materials if enclosed within a building but not storage yards. Open and outdoor storage (i.e. <br />storage yards) require a conditional use permit. The existing single family house is a non- <br />conforming use as detailed above.
