2. The City Attorney reviewed the status of title/property ownership related to the <br />final plat and notes the title commitment shall be updated. <br />3. A 2"d Addition Development Agreement has been completed. <br />4. Conditions attached to approval of the preliminary plat have been fulfilled or <br />secured by the Development Agreement. <br />5. All fees, charges and escrow related to the preliminary or final plat have been paid <br />in full. <br />BE IT FURTHER RESOLVED by the City Council of the City of Lino Lakes hereby <br />approved Watermark 2nd Addition PUD Final Plan/Final Plat subject to the following <br />conditions: <br />1. Outlot A is preserved as permanent Open Space and shall be owned and <br />maintained by a Homeowner's Association in accordance with an approved <br />Restoration and Management Plan. <br />BE IT FURTHER RESOLVED by the City Council of the City of Lino Lakes hereby <br />approves the Development subject to the following items being addressed prior to <br />issuance of building permit within the 2nd Addition: <br />1. All comments from the City Engineer letter dated October 2, 2019 shall be <br />addressed. <br />2. The 2"d Addition Development Agreement shall be approved by the City Council, <br />executed and recorded against the property. <br />3. The title commitment shall be updated to the date of the plat recording. <br />4. A copy of the recorded deed for Outlot A to the HOA shall be submitted to the <br />City. <br />5. A copy of the recorded Permanent Trail Easement with Description Sketch for the <br />trail on Outlot A shall be submitted to the City. <br />6. Copies of the recorded HOA documents shall be submitted to the City. <br />7. The applicant shall provide a Restoration and Management Plan specific to Outlot <br />A. <br />8. The applicant shall provide a construction timeline for the trail along CSAH 54 <br />(20th Avenue) and for the tot lot in the townhome neighborhood. <br />9. Watermark 2nd Addition Home Plans Booklet: <br />a. The 2nd Addition final plat area shall be highlighted on page 2, Land Use <br />Plan. <br />b. Color packages and anti -monotony plans shall be included to ensure that <br />the homes elevations are varied with a minimum of five different styles <br />and those homes in proximity to each other not look alike in terms of the <br />combination of color of siding, accent and roofing materials. <br />c. The booklet shall include a "High Visibility Structures" exhibit specific to <br />the 2"d Addition final plat detailing specific lots and blocks that pertain to <br />the requirement. <br />i. The architectural features shall also be included on the building <br />permit house plans. <br />2 <br />
