CITY OF LINO LAKES RESOLUTION NO. 19-151 RESOLUTION DECLARING A CITY COUNCIL VACANCY AND CALLING FOR A SPECIAL ELECTION TO BE HELD ON FEBRUARY 11, 2020 WHEREAS, Councilmember Rob Rafferty received the most votes for the Mayor position following the November 5, 2019 municipal election; and WHEREAS, effective December 31, 2019, a vacancy will occur on the City Council following Rob Rafferty's written resignation as Councilmember with two years remaining on his term; and WHEREAS, Section 4.05 of the Lino Lakes City Charter provides that there shall be a special election to elect a successor to serve the remainder of the unexpired term when a Council vacancy occurs within 365 days or more remaining in the term of the vacated office; and WHEREAS, the City Council has determined that holding the special election to fill the unexpired term of Councilmember Rafferty on February 11, 2020, in conjunction with the County Board election, is in conformity with applicable state law and is in the best interest of the citizens of Lino Lakes; and WHEREAS, once the vacancy is declared and the special election is called, the first legal requirement is posting the notice of candidate filing two weeks prior to the start of the candidate filing period in accordance with Minnesota Statute 205.13. NOW, THEREFORE, BE IT RESOLVED by the Lino Lakes City Council that the Council hereby declares a vacancy in the position of Councilmember, effective December 31, 2019, and orders a special election for the City of Lino Lakes to be held on the second Tuesday of February, that being February 11, 2020, for the purpose of electing a City Councilmember to serve the unexpired term of Rob Rafferty. Adopted by the Council of the City of Lino Lakes this 12th day of November 2019.
