CITY OF LINO LAKES <br />RESOLUTION NO. 19-151 <br />RESOLUTION DECLARING A CITY COUNCIL VACANCY AND <br />CALLING FOR A SPECIAL ELECTION TO BE HELD ON FEBRUARY 11, 2020 <br />WHEREAS, Councilmember Rob Rafferty received the most votes for the Mayor position <br />following the November 5, 2019 municipal election; and <br />WHEREAS, effective December 31, 2019, a vacancy will occur on the City Council following <br />Rob Rafferty's written resignation as Councilmember with two years remaining on his term; and <br />WHEREAS, Section 4.05 of the Lino Lakes City Charter provides that there shall be a special <br />election to elect a successor to serve the remainder of the unexpired term when a Council <br />vacancy occurs within 365 days or more remaining in the term of the vacated office; and <br />WHEREAS, the City Council has determined that holding the special election to fill the <br />unexpired term of Councilmember Rafferty on February 11, 2020, in conjunction with the <br />County Board election, is in conformity with applicable state law and is in the best interest of the <br />citizens of Lino Lakes; and <br />WHEREAS, once the vacancy is declared and the special election is called, the first legal <br />requirement is posting the notice of candidate filing two weeks prior to the start of the candidate <br />filing period in accordance with Minnesota Statute 205.13. <br />NOW, THEREFORE, BE IT RESOLVED by the Lino Lakes City Council that the Council <br />hereby declares a vacancy in the position of Councilmember, effective December 31, 2019, and <br />orders a special election for the City of Lino Lakes to be held on the second Tuesday of February, <br />that being February 11, 2020, for the purpose of electing a City Councilmember to serve the <br />unexpired term of Rob Rafferty. <br />Adopted by the Council of the City of Lino Lakes this 12th day of November 2019. <br />The motion for the adoption of the foregoing resolution was introduced by Councilmember <br />z and was duly seconded by Councilmember e_ and upon vote <br />being taken thereon, the following voted in favor thereof: <br />lj-t c s , twi vt+-II��( 2e <br />The following voted against same: <br />IVY`ve -:4I, (.4 t VL�c 44l <br />Jeff Reinert, M(ay6r <br />ATTEST: <br />
