CITY OF LINO LAKES <br />RESOLUTION NO. 19-152 <br />RESOLUTION APPROVING THE FINAL PLAT <br />FOR HOULE ESTATES SECOND ADDITION <br />WHEREAS, the City received an application for Final Plat approval for Houle Estates <br />Second Addition hereafter referred to as "Development"; and <br />WHEREAS, City staff completed a review of the proposed "Development" based on the <br />following plans and information: <br />• Final Plat prepared by EVS , Inc. received September 27, 2019 <br />• Buffer Easement Exhibit prepared by EVS, Inc. dated September 25, 2019 <br />• Easement Exhibit prepared by EVS, Inc. dated March 12, 2019 <br />• Title Commitment issued by Old Republic Title Insurance Company dated <br />September 25, 2019; and <br />WHEREAS, a public hearing was held before the Planning & Zoning Board on June 14, <br />2017 and the Board recommended approval of the Houle Addition Preliminary Plat; and <br />WHEREAS, the City Council approved the Preliminary Plat with Resolution No. 17-63; <br />and <br />WHEREAS, Planning & Zoning Board reviewed and recommended approval of the <br />Houle Estates Second Addition final plat at the November 13, 2019 meeting; and <br />WHEREAS, the proposed development is not considered premature and meets the <br />performance standards of the subdivision and zoning ordinance; and <br />NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino <br />Lakes hereby makes the following: <br />FINDINGS OF FACT <br />1. The final plat substantially conforms to the approved preliminary plat subject to the <br />conditions listed below. <br />2. The City Attorney reviewed the title commitment and notes that mortgage lender <br />consent to plat is required. <br />3. A Development Agreement has been completed. <br />4. Conditions attached to approval of the preliminary plat have been fulfilled or <br />secured by the Development Agreement. <br />5. All fees, charges and escrow related to the preliminary or final plat have been paid <br />in full. <br />1 <br />
