8 <br /> <br />Reshanau Lake is an impaired, recreational development lake and efforts to protect and <br />improve the natural resource should be implemented with any development. A native vegetated <br />shoreline buffer will be required as a stormwater management best management practice <br />(BMP) to minimize runoff pollutants from entering the lake. The buffer will also help stabilize <br />the shoreline, reduce erosion and support aquatic plants and wildlife. An average 20 foot wide <br />but no less than 10 foot minimum wide native vegetated buffer zone extending from the <br />shoreline shall be installed and maintained on both Lot 1 and Lot 2. As recommended by the <br />Planning & Zoning Board, a 20 foot wide access opening to the lake is allowed. A landscape <br />plan detailing the buffer plantings and maintenance shall be submitted. <br /> <br />Environmental Assessment Worksheet (EAW) <br /> <br />An Environmental Assessment Worksheet is not mandated. The two (2) unattached residential <br />units are under the 250 unattached unit threshold required for a mandatory EAW. <br /> <br />Wetlands <br /> <br />A Wetland Delineation Report was completed by Jacobson Environmental, PLLC on August 2, <br />2019. A WCA Notice of Decision approving the wetland delineation was issued by RCWD on <br />September 16, 2019. Three (3) basins were delineated. Basin 1 is 0.016 acres and Basin 2 is <br />0.024 acres. Both are located within the rear yard of Lot 1. Basin 3 is 0.008 acres and is <br />adjacent to the Reshanau Lake shoreline on both Lot 1 and Lot 2. No wetland impacts are <br />proposed. Per RCWD, Rule F is not triggered; therefore, no WMC wetland buffers are <br />required. A drainage and utility easement 10 feet above the delineated wetland is provided. <br /> <br />Floodplain <br /> <br />The 2015 DFIRM indicates Zone AE floodplain on both Lot 1 and Lot 2. The FEMA base <br />flood elevation (BFE) is 887. Per Sheet 6, CLOMR-F Exhibit, the applicant is proposing 38 cy <br />of floodplain fill and 39 cy of compensatory storage. The applicant shall obtain a CLOMR-F <br />from FEMA to revise the floodplain map. It should be noted that any future proposed <br />structures such as accessory structures shall meet the floodplain ordinance requirements. <br /> <br />Shoreland Management Overlay <br /> <br />The general purpose and intent of the Shoreland Management Overlay ordinance is to protect <br />public waters. Per the ordinance Policy statement, the uncontrolled use of shorelands of the <br />city affects the public health, safety and general welfare not only by contributing to pollution of <br />public waters, but also by impairing the local tax base. Therefore, it is in the best interests of <br />the public health, safety and welfare to provide for the wise subdivision, use and development <br />of shorelands of public waters. <br /> <br />As discussed, the site is located in a Shoreland Management Overlay district of Reshanau Lake. <br />This lake is a classified as a Recreational Development Lake and has an 883.5 OHWL <br />elevation. The required OHWL setback for both Lot 1 and Lot 2 is 75 feet for sewered lots. <br />The proposed setback on Lot 1 is 87.6 feet and is compliant. The current setback from the <br />existing house on Lot 2 is 73.5 feet. The house is considered legal non-conforming. <br />
