6 <br /> <br />Under the Shoreland Management Overlay Ordinance, watercourses refer to tributary rivers <br />and streams. Rice Creek and Hardwood Creek are the only watercourses listed in Lino Lakes <br />and are not applicable to the Poehling Addition. Therefore, lot area will be measured above the <br />OHWL of Reshanau Lake. Per the Preliminary Plat: <br /> <br />Lot Area Lot 1 Lot 2 Total <br />Required 20,000 sf 20,000 sf 20,000 sf 40,000 sf <br />Area Above OHWL 17,598 sf 16,425 sf 34,023 sf <br />Variance Required 2,402 sf 3,575 sf 5,977 sf <br /> <br />Street Setback <br /> <br />The required local street setback is 30 feet. The applicant is requesting a 25 foot street setback <br />along West Shadow Lake Road for Lot 2. Reducing the front setback allows more separation <br />from the building pad to the existing wetland and OHWL. There will also be less floodplain <br />impact and impervious surface. <br /> <br />The existing street setback for Lot 1 is 22.2 feet. Staff is not sure why there is a deviation on <br />Lot 1 other than the fact that the house was constructed in 1984 and surveys were not required <br />and setbacks may not have been verified. <br /> <br />Building Requirements <br /> <br />At the time of building permit, the single family dwelling unit will be reviewed for compliance <br />regarding floor area, garage and design and construction standards. <br /> <br />Subdivision Ordinance <br /> <br />The legal description of the subject site is Lot 1, Block 1, Reshanau Shores. It was platted in <br />1982. <br /> <br />Per Section 1001.076(2) of the Subdivision Regulation, any subdivision that results in the <br />creation of one or more sewered residential lots shall be platted in full compliance with <br />preliminary plat and final plat requirements and therefore, it is not a minor subdivision. <br /> <br />Conformity with the Comprehensive Plan and Zoning Code <br /> <br />The preliminary plat is consistent with the comprehensive plan for low density residential <br />development and zoning code requirements for R-1X, Single Family Executive as discussed <br />above. <br /> <br />Blocks and Lots <br /> <br />The preliminary plat contains Lot 1 and Lot 2, Block 1, Poehling Addition. As noted above, <br />Lot 1 contains the existing house and Lot 2 proposes a single family home. Variances are <br />required for lot size and street setback.
